试论社区矫正制度的构建与完善

【摘要】：社区矫正是西方国家首先推行的一种刑罚执行模式，其理念始于19世纪末近代学派的行刑社会化思想，体现的是一种刑罚人道主义观念。行刑社会化的基本特征是用“矫正”替换“刑罚”，把矫正区分为“监禁矫正”和“社区矫正”，并强调了社区矫正的重要意义，突出了教育、挽救罪犯的目的，实践中收到了良好的效果，，已成为世界各国刑罚体制改革发展的趋势。过去，我国没有使用社区矫正的名称，但是在刑罚制度中包含了管制、缓刑、假释等社区矫正的内容。2003年开始试点社区矫正工作至今，取得了比较好的成效，也总结了一些好的做法和经验，推动了社区矫正制度的发展。但是与发达国家相比，我国社区矫正制度还有许多亟待改进的地方。本文第一部分解释了社区矫正的概念及适用对象，并从“刑罚人道主义”、“宽严相济刑事司法政策”及“恢复性司法理念与制度”三个方面阐述了社区矫正制度的理论基础。第二部分从我国社区矫正的立法现状和执行现状入手，通过数据统计及案例调研，分析了我国社区矫正工作中存在的问题。第三部分是本文的重点，以“宽严相济刑事司法政策”和“恢复性司法”为指导，从“建立合理的社区矫正决定机制”和“建立科学的社区矫正执行机制”两方面入手，从完善社区矫正审前调查、提高缓刑、假释适用率、建立专业化的社区矫正工作者队伍、规范人户分离社区矫正人员管理和健全风险及矫正效果动态评估体系等六个角度详细阐述了如何构建和完善我国社区矫正制度，并提出了相应的立法建议，以期对我国《社区矫正法》的制定和出台贡献微薄之力。
[Abstract]:Community correction is one of the first penalty execution models in western countries. Its concept began with the socialization of execution thought of modern school at the end of 19th century. The basic characteristic of the socialization of execution is to replace "penalty" with "correction", to distinguish correction into "imprisonment correction" and "community correction", and to emphasize the importance of community correction and to highlight education. The purpose of saving criminals has received good results in practice, which has become the trend of the reform and development of penalty system in various countries in the world. In the past, our country did not use the name of community correction, but in the penalty system it included control and probation. Since 2003, the pilot community correction work has achieved good results, summed up some good practices and experiences, and promoted the development of community correction system. But compared with the developed countries, The community correction system of our country still has many places that need to be improved urgently. The first part of this paper explains the concept and applicable object of community correction. It also expounds the theoretical basis of community correction system from three aspects of "penalty humanitarianism", "criminal justice policy of combining leniency with severity" and "concept and system of restorative justice". The second part begins with the current legislative and executive situation of community correction in China. Through data statistics and case study, this paper analyzes the problems existing in the work of community correction in our country. The third part is the focus of this paper, which is guided by "Criminal Justice Policy of combining leniency and severity" and "Restorative Justice". Starting from the two aspects of "establishing reasonable decision mechanism of community correction" and "establishing scientific execution mechanism of community correction", this paper begins with the improvement of pretrial investigation of community correction, raising the application rate of probation and parole, and establishing a professional team of community correction workers. This paper expounds in detail how to construct and perfect the community correction system of our country from the six angles of standardizing the management of community correction personnel separated from household and perfecting the risk and the dynamic evaluation system of correction effect, and puts forward the corresponding legislative suggestions. With a view to the establishment and introduction of Community Correction Law, the contribution of meager contribution.
