【摘要】： 道路交通安全管理体制应当采用何种模式是我国争论几十年的问题。我国道路交通安全管理体制历经了由交通、公安交警两家共同管理,由公安部门一家管理,由交通部门一家管理的反复变化的过程。1986年改革,确立了城乡道路交通安全管理统一由公安机关负责的体制。该体制发挥了公安机关行政司法职能的特性,显示了一定的优越性,是原交通(监理)部门无法比拟的。但随着时代的发展,涉及人、车、路、环境等诸多因素逐渐发生变化,尤其是高速公路大规模建设和发展,单纯由公安部门管理交通安全已不再适应时代发展的需要,出现了单一由公安部门管理交通安全的现行体制与交通安全综合性管理的客观需求不相适应的诸多问题和矛盾。本文拟从体制创新、提高行政效能,并兼顾维护法律正义和公平的角度,创立一种由“交通部门统一管理,交通、公安双重领导、集道路规划、管理、执法为一体”的综合性交通安全管理新体制。该体制既保持了八六改革的成绩,发扬公安机关在交通管理的作用,又能克服现行体制割裂了交通安全管理的系统性和综合性的弊端,坚持系统性、统一性管理交通的特点,扬长避短,兴利除弊,符合交通管理规律,更能适应未来交通发展的需要。
[Abstract]:What kind of mode should be adopted in the road traffic safety management system has been debated for decades in our country. Our road traffic safety management system has been managed jointly by traffic, public security and traffic police, and managed by one public security department. In 1986, the reform established a unified system of urban and rural road traffic safety management, which is the responsibility of the public security organs. This system has played the characteristics of the administrative and judicial functions of the public security organs. It shows certain superiority, which the former traffic (supervision) department can not compare. However, with the development of the times, many factors, such as people, cars, roads, environment and so on, have gradually changed, especially the large-scale construction and development of highways. The management of traffic safety by the public security departments alone is no longer suitable for the needs of the development of the times. There are many problems and contradictions between the current system of traffic safety management by the public security department and the objective demand of the comprehensive traffic safety management. This paper intends to innovate the system and improve the administrative efficiency. And from the point of view of safeguarding legal justice and fairness, we have created a kind of road planning and management system under the dual leadership of the transportation department, traffic and public security. The new comprehensive traffic safety management system, which integrates law enforcement, has not only maintained the achievements of the 1986 reform, but also carried forward the role of the public security organs in traffic management. It can also overcome the systematic and comprehensive drawbacks of traffic safety management, persist in systematic and unified management of traffic characteristics, promote strengths and circumvent weaknesses, do beneficial things, remove drawbacks, and conform to the laws of traffic management. More able to meet the needs of future traffic development.
