恐怖主义犯罪的法律对策研究

【摘要】：恐怖主义犯罪严重地危害世界和平与安全,造成了无数平民伤亡及财产的重大损失,加深了国家、地区、民族以及宗教之间的矛盾,严重地阻碍了各国经济、社会的发展与进步,已经引起了各国政府的广泛关注。我国也不是恐怖犯罪的净土,近些年来,我国主要大城市和西部地区也受到了恐怖主义犯罪活动的威胁,影响了社会的稳定与和谐。采取何种有效方法和措施惩治和消除恐怖主义犯罪行为已经成为包括我国在内的各国政府和人民共同关心的课题。在各国所采取各种措施和方法中,法律对策与政治、军事手段相比,在预防、打击、惩治、消灭恐怖主义犯罪方面起到了促进国际合作、整合本国执法力量对其进行严厉制裁的重要作用。因此,世界主要国家都制定了针对恐怖主义犯罪的专门立法、并通过强化执法力量和手段、加强国际法律合作等相关的法律对策,积极预防和严厉惩治恐怖主义犯罪行为,保护和避免本国、社会和国民遭受恐怖主义犯罪活动的威胁和侵害,进而达到维护社会稳定,促进社会、经济正常发展的目的。就我国来说,以法律为武器惩治恐怖主义犯罪行为,不断完善我国防范、打击恐怖主义犯罪的法律对策,对于维护我国社会稳定、保障人民生命、财产安全也同样具有重要的现实意义。本文从分析国内外关于恐怖主义犯罪的概念入手,通过比较研究,在从刑法学的角度提出恐怖主义犯罪概念的基础上,通过比较研究国际和国内针对恐怖主义犯罪的相关法律对策,结合当前我国在针对恐怖主义犯罪法律对策的现状和不足之处,试从完善相关刑事立法、加强国内行政立法、依法严控涉恐资金、制定反恐怖专门法律及创设控制恐怖主义犯罪的多重合作的综合法律机制等角度出发进行分析,就如何完善我国关于恐怖主义犯罪的相关法律对策提出了自己的一些思考。
[Abstract]:The crime of terrorism seriously endangers world peace and security, causes numerous civilian casualties and great losses of property, deepens the contradictions among countries, regions, nationalities and religions, and seriously impedes the economies of all countries, The development and progress of society have aroused the widespread concern of the governments of all countries. China is not a pure land for terrorist crimes. In recent years, the major cities and western regions of our country have also been threatened by terrorist criminal activities. Which have affected the stability and harmony of society... the effective methods and measures taken to punish and eliminate the criminal acts of terrorism have become a subject of common concern to all governments and peoples, including my own, among the various measures and methods adopted by States, Compared with political and military measures, legal countermeasures have played an important role in promoting international cooperation in preventing, combating, punishing and eliminating terrorist crimes and in integrating national law enforcement forces to impose severe sanctions on them. Major countries in the world have formulated special legislation against terrorist crimes and actively prevent and severely punish terrorist crimes by strengthening law enforcement forces and means, strengthening international legal cooperation and other relevant legal countermeasures. To protect and avoid the threat and aggression of their own country, society and people from terrorist criminal activities, thereby achieving the purpose of maintaining social stability and promoting normal social and economic development. As far as our country is concerned, Taking the law as a weapon to punish terrorist crimes and constantly perfecting our country's legal countermeasures for preventing and cracking down on terrorist crimes will safeguard the social stability of our country and safeguard the lives of the people. Property security is also of great practical significance. This paper begins with the analysis of the concept of terrorist crime at home and abroad, and puts forward the concept of terrorist crime from the angle of criminal law through comparative study. Through the comparative study of international and domestic legal countermeasures against terrorist crimes, combined with the current situation and deficiencies of our country's legal countermeasures against terrorist crimes, try to improve the relevant criminal legislation, strengthen domestic administrative legislation, From the angles of strictly controlling terrorist funds according to law, formulating special anti-terrorist laws and creating a comprehensive legal mechanism for multi-level cooperation in controlling terrorist crimes, This paper puts forward some thoughts on how to perfect the relevant legal countermeasures of terrorism crime in our country.
