【摘要】： 侦查程序是整个刑事诉讼程序的重要组成部分，它如同诉讼大厦的基石。西方学者虽然对此进行了一定的研究和探索，但由于受其侦查模式背景的影响，并未将注意力放在侦查程序上。我国对此研究尚属起步。在他们的论著中，虽作过有益的探究，但缺乏系统性和深入性。基于此，本文对侦查程序从理论和实践的结合上作了较为全面和深入的论述：首先，，构建了侦查程序的基本理论框架，即侦查程序的价值定位和侦查程序的目的；由于价值目标和目的不同，导致侦查模式的差异，接着对三大侦查模式进行了一番比较研究；继而在分析我国侦查程序的特点和缺陷的基础上，对我国侦查程序的立法完善进行了适合我国国情的开拓性的探讨。
[Abstract]:The investigation procedure is an important part of the whole criminal procedure, which is as big as the lawsuit. The cornerstone of Xiamen. Although Western scholars have made some research and exploration on this issue, The influence of the background of the investigation mode does not focus on the investigation procedure. The research is still in its infancy. Although they have made useful explorations in their works, they lack a systematic approach. Based on this, this paper makes a combination of theory and practice to investigate the procedure. First of all, it constructs the basic theoretical framework of investigation procedure. That is, the value orientation of the investigation procedure and the purpose of the investigation procedure; In the same way, it leads to the difference of investigation mode, and then makes a comparative study on the three major investigation models. Secondly, on the basis of analyzing the characteristics and defects of the investigation procedure in our country, the investigation of our country is carried out. The legislative perfection of the procedure has carried on the pioneering discussion suitable for our country's national conditions.
