【摘要】：在当前的刑事侦查实践中，能够从现场提取的痕迹物品及其它证据较以前越来越少。摆在侦查人员面前的途径有两条：一是通过各种途径提高采痕率及其它证据的收集；二是对已收集的痕迹物品及其它证据的充分利用。而要提高采痕率和其它证据的收集，充分利用痕迹物品等证据，最重要的就是转变侦查人员的思想观念及思维模式、方法。犯罪现场再现就是针对侦查人员传统的侦破方法的改造，试图通过犯罪现场再现，来有效地发现并且提高痕迹物品及其它证据的利用率，以通过犯罪现场再现充分发挥痕迹物证及其它证据在侦查中的作用。全文共分五部分，共三万六千余字。第一部分：基本理论。从犯罪现场再现的概念、历史来源、发展状况、犯罪现场再现的性质等方面论述，同时阐述犯罪现场再现在理论和实践中的意义，犯罪现场再现与传统的案情分析的区别。从而使犯罪现场再现与现场分析、犯罪画像等等相区别。第二部分：犯罪现场再现的基本原则。犯罪现场再现作为一种新的侦查方法或模式，应有自己的指导原则，为这种方法或模式提供指引。这部分主要论述的基本原则有：客观性原则；相关性原则；科学性原则；逻辑性原则。第三部分：犯罪现场再现的一般步骤。进行犯罪现场再现应该遵循一定的步骤，才能有条不紊地进行。进行犯罪现场再现，首先应该收集进行再现所必须的再现资料，以此为基础，实现犯罪现场的物质再现，认识犯罪人的行为，进而刻画犯罪人的心理特征及其它特征，，然后通过调查访问、检验、鉴定等验证、修正再现。第四部分：犯罪现场再现的一般方法。在犯罪现场再现的一般原则指导下，遵循一定的步骤，按照犯罪现场再现的一般方法，进行再现活动，认识案件事实，这部分主要论述犯罪现场再现的基本方法：分析推理再现法；回忆再现法；技术检验再现法；实验再现法等再现方法。第五部分：犯罪现场再现应注意的要点。这部分主要论述在进行犯罪现场再现时应掌握的几个要点：重点做好侦查终结时的犯罪现场再现；犯罪现场再现的人员素质要求；核实再现资料的动态变化；判明犯罪现场有无伪装；区分犯罪现场再现证据资料的等级差别；犯罪嫌疑人的交待应与
[Abstract]:In the current practice of criminal investigation, there are fewer and fewer trace items and other evidence which can be extracted from the scene.
