【摘要】： 学界以往对犯罪人通常是从其作为犯罪主体的犯罪化角度进行探讨,本文转换对犯罪人的研究视角,从犯罪人被害化的角度来探讨犯罪人问题。由于犯罪人被害化问题在我国尚无系统性研究,研究成果散见于犯罪学、刑法学、刑事诉讼法学之中,本文通过对犯罪人被害化问题进行体系化理论化的研究,开探讨犯罪人被害化之先河,以唤起人们对犯罪人被害化现象的普遍重视。文章采用了刑事一体化的研究方法,除引言和结论外,分为三个部分对犯罪人被害化问题进行探讨。第一部分提出了犯罪人被害化的概念,犯罪人被害化在某种程度上是一个包括犯罪人在犯罪行为实施之前受各种因素的影响成为国家、社会、他人的替罪羊,在犯罪行为实施后受到立法、司法的不公正对待,在定罪量刑后受到不公正处遇和回归社会后受到不公正社会待遇的动态被害化过程。文章第二部分在文献研究的基础上对犯罪人被害化的事前、事中、事后表现形式进行了系统化的阐明,以使人们对犯罪人被害化现象有一个整体清晰的把握。文章最后一部分列举了犯罪人被害化问题的相关解决措施,提出对犯罪人被害化问题不仅需要动用政治、经济、教育、文化力量,同时也需要采取具体的立法、司法、犯罪人处遇、再社会化等方面的改进举措。通过事前、事中、事后的被害化防治措施的施行,以最大限度地保障犯罪人权益。
[Abstract]:In the past, the academic circles usually discussed the criminals from the angle of their criminalization as the subject of crime. From the angle of victimization of the criminal, the author discusses the problem of the criminal. Because there is no systematic research on the victimization of the criminal in our country, the research results are scattered in criminology, criminal law, criminal procedure law. By systematizing the problem of victimization of criminals, this paper explores the first step of victimization of criminals, in order to arouse the general attention to the phenomenon of victimization of criminals. The article adopts the research method of criminal integration, besides the introduction and conclusion, it is divided into three parts to discuss the problem of victimization of the criminal. The first part puts forward the concept of the victimization of the criminal. To a certain extent, the victimization of a criminal includes the fact that the criminal is affected by various factors before the commission of the crime. He becomes the scapegoat of the country, society and others, and is unjustly treated by legislation and justice after the crime has been committed. The dynamic victimization process of being treated unjustly after conviction and sentencing and being treated by unfair society after returning to society. In order to make people have a clear understanding of the phenomenon of victimization of criminals, the last part of the article lists the relevant measures to solve the problem of victimization of criminals. It is proposed that not only political, economic, educational and cultural forces are needed to improve the problem of victimization of criminals, but also specific legislative, judicial, criminal treatment and re-socialization measures should be taken. The measures of prevention and control of victimization after the event are carried out in order to protect the rights and interests of the offender to the maximum extent.
