法学视野中的社区青少年研究

【摘要】：社区青少年是违法犯罪的高危人群,社区青少年违法犯罪人一般占违法犯罪青少年群体的百分之六十左右。2004 年全国预防青少年违法犯罪暨学校及周边治安综合治理工作会议指出,就预防青少年违法犯罪而言,未成年人、闲散(社区)青少年、进城务工青年、罪错青少年等将是重点人群。社区青少年是一个社会性的问题。这一群体的产生和发展情况,既有国家政治、经济和社会发展的宏观背景,也与就业、教育、行政管理等体制相关,还跟社区青少年个体的自身情况紧密联系。社区青少年脱离了学校的教育管理,处于失业的消极状态,再加上不成熟的年龄特征,成为了违法犯罪和受害的高危群体。许多违法犯罪和受害的社区青少年在违法犯罪和受害之前,处于家庭、学校、社会“三不管”的真空地带,游离于社会控制之外,社会关系网络非常薄弱。和成年人相比,青少年是弱势群体;和其他青少年相比,社区青少年是弱势群体。对社区青少年,必须从更广阔、更深远的视角来思考,而不能因为其消极的生存现状,就给他们帖上“问题青少年”、“不良青少年”等道德败坏的标签,一棍子打死。从本质上讲,社区青少年工作,既是一项社区青少年违法犯罪的预防控制工作,更是一项依法维护社区青少年利益、促进社区青少年健康发展的服务工作。中央明确要求,针对闲散(社区)青少年,各地要专门建立区域性的信息管理系统,准确掌握他们的基本情况,分析他们面临的实际困难和问题,根据不同的情况,通过跟踪服务、专人联系、定向辅导等方法,在生活上解困,学习上帮助,
[Abstract]:Young people in the community are at high risk of breaking the law and committing crimes. Community juvenile delinquents generally account for about 60% of juvenile delinquents. The National Conference on Comprehensive Administration of Juvenile Delinquency and School and its surrounding Public order pointed out that as far as the prevention of juvenile delinquency is concerned, Minors, idle (community) teenagers, migrant workers, delinquent youth and so on will be the key population. Community youth is a social problem. The emergence and development of this group have not only the macro-background of national political, economic and social development, but also related to employment, education, administration and other systems. It is also closely related to the individual situation of the community teenagers. Community teenagers are out of school education management and are in a negative state of unemployment, coupled with immature age characteristics. It has become a high-risk group for delinquency and victimization. Many delinquent and victimized community adolescents are in the vacuum of family, school and society "three no" before committing crimes and victimization, and are outside social control. Social networks are very weak. Compared with adults, teenagers are vulnerable groups. Compared with other teenagers, community teenagers are vulnerable groups. For community teenagers, we must think from a broader, more far-reaching perspective. Because of their negative living situation, we should not put them on the label of "problem youth", "bad youth" and other bad morals, and beat them to death with a blow. In essence, community youth work is not only a work to prevent and control juvenile delinquency in the community, but also a service to safeguard the interests of young people in the community according to law and to promote the healthy development of young people in the community.
