甘肃省未成年人犯罪问题初探

【摘要】： 近年来，我国未成年人犯罪呈现不断上升趋势，而且出现了团伙化、暴力化、低龄化等新特点，并已成为危害社会治安，影响社会稳定，，破坏和谐社会建设的一个亟待解决的社会问题。因此分析未成年人犯罪原因、探索预防与控制未成年人犯罪的办法就成为当务之急。本文以甘肃省为例，通过调查获取大量第一手资料，并以赫希的社会控制理论为基本理论依据，运用统计分析、分类、对比、归纳等方法对未成年人犯罪问题进行分析、探讨，希望能为我省预防和控制未成年人犯罪工作提供一些有益参考。全文共分三部分。第一部分通过对我省未成年人犯罪状况、涉案罪名、犯罪人员文化程度以及身份等数据资料进行客观分析进而对我省未成年人犯罪现状和趋势予以评价：犯罪率高于全国平均水平，犯罪现象尚未得到有效控制；未成年人犯罪多为侵犯公民人身和民主权利罪(故意伤害、故意杀人、强奸、绑架等)、侵犯财产类罪(抢劫、盗窃、诈骗、抢夺等)，并以侵财类犯罪尤为突出；低龄化现象日趋严重：团伙犯罪成为其主要形式；犯罪人文化程度普遍较低，其中初中文化程度居多；农村未成年人犯罪率明显高于城市，罪犯身份主要集中于农民、无业人员和学生(包括在校和辍学)；在校生犯罪率增长以及涉毒案件有增加趋势等。第二部分以美国著名的犯罪学家、社会学家特拉维斯·赫希(TravisHirschi)所提出的“社会控制理论”(Social control theory)为理论基础进行理性分析：现行相关法律、法规的可操作性不足；未成年人抵制对家庭的依恋；学校教育的缺失；未成年人拒绝参与传统活动以及社会不良因素的影响等是我省未成年人犯罪的主要原因。第三部分在了解我省未成年人犯罪现状和分析原因的基础上，从完善立法、增强未成年人对家庭的依恋、提高未成年人对传统活动的参与度以及帮助未成年人树立正确的道德信仰和法律信仰等几方面探讨构建预防和控制未成年人犯罪体系。
[Abstract]:In recent years, juvenile delinquency in our country has been on the rise, and has emerged some new characteristics, such as gang, violence and younger age, and has become a danger to public order and social stability. Therefore, it is urgent to analyze the causes of juvenile delinquency and explore the ways to prevent and control juvenile delinquency. This paper takes Gansu Province as an example, obtains a large number of first-hand information through investigation, and takes Hersh's social control theory as the basic theoretical basis, and uses the methods of statistical analysis, classification, contrast, induction and so on to analyze the juvenile delinquency problem. This paper hopes to provide some useful reference for the prevention and control of juvenile delinquency in our province. This paper is divided into three parts. The first part, through the situation of juvenile delinquency in our province, the crime involved, The status quo and trend of juvenile delinquency in our province are evaluated by the objective analysis of the data such as the degree of education and identity of the criminal personnel: the crime rate is higher than the national average, and the crime phenomenon has not been effectively controlled; Most of the crimes committed by minors are crimes of infringing on citizens' personal and democratic rights (intentional injury, intentional killing, rape, kidnapping, etc.) and crimes against property (robbery, theft, fraud, snatch, etc.), especially in the crime of invading property; The phenomenon of younger age is becoming more and more serious: gang crime becomes the main form of crime; the level of education of the offenders is generally low, among which the junior high school education level is the majority; the crime rate of minors in rural areas is obviously higher than that of the cities, and the criminal status is mainly concentrated in the peasants. Unemployed persons and students (including school and school dropouts; the increase in the crime rate of school students and drug-related cases have an increasing trend. " The second part takes Travis Hirschi, a famous American criminologist and sociologist, as the theoretical basis of "Social control the Theory of Control": the current relevant laws and regulations are not operable; The main reasons of juvenile delinquency in our province are that minors resist attachment to their families, lack of school education, minors refuse to participate in traditional activities and the influence of bad social factors. The third part, on the basis of understanding the current situation of juvenile delinquency in our province and analyzing the reasons, from perfecting legislation, strengthening the attachment of minors to the family, To improve the participation of minors in traditional activities and to help minors to establish correct moral beliefs and legal beliefs and other aspects of the construction of prevention and control of juvenile delinquency system.
