论构建我国社区服务刑

【摘要】：社区服务刑业已在诸多法治发达的国家里闪耀着夺目的光彩，在每个国家里获得了非常好的刑罚效用，也得到了民众的广泛支持与配合。但社区服务刑在我国还算是个比较生疏的概念，它的内容和我国的公益劳动有一定的相似性，但又绝不能两者混为一谈。本文通过对社区服务刑的概念、发展及特点的梳理，对构建我国社区服务刑的原因、条件及当前我国社区服务存在的问题进行了分析，，最后给出了笔者的完善建议。
[Abstract]:The punishment of community service has shone brilliantly in many developed countries with the rule of law, and has obtained very good penalty effect in each country, and has also been widely supported and cooperated by the public.But the punishment of community service is still a new concept in our country. Its content is similar to the public service labor in our country, but it must not be mixed up.Through the analysis of the concept, development and characteristics of community service punishment, this paper analyzes the reasons, conditions and problems existing in the construction of community service punishment in our country, and finally gives the author's suggestions for perfection.
