中国劳动教养制度的反思及改革初论

【摘要】:从稳定政治需要到满足治安需要,独具中国特色的劳动教养制度已走过40年的风雨历程。长期的实践证明,这项制度有其存在的价值基础,但由于立法规定的粗疏,尤其是程序规范的缺损,劳动教养制度在实施中也存在诸多问题,其合法性、合理性和正当性不断受到质疑。面对延续了40多年的劳动教养制度,也许并不是单纯的“合法性”探讨所能解决的,仅仅通过立法只能提供该制度以形式上的“正当性”,却不一定能解决该制度所内含的实质上的“合理性”问题;简单地宣判劳动教养制度的终止,只能在“劳动教养”的形式上求得“圆满”的结果,却难以在人权保障乃至社会稳定和发展方面有所收益。 不论劳动教养本身存在的问题有多么严重,都终究不过是一种表象,这一表象的深层所反映的其实是如何限制国家公共权力以及如何保证个人权利和自由不受任意侵犯的问题。作者从历史的角度,对劳动教养制度的产生、变化过程作一简要的回顾,从实体和程序方面分析劳动教养制度的缺陷和问题,并就改革劳动教养制度提出自己的方案和见解。
[Abstract]:From the need of stabilizing politics to satisfying the need of public order, the system of reeducation through labor with Chinese characteristics has gone through 40 years.Long-term practice has proved that this system has its value basis, but due to the carelessness of legislative provisions, especially the defect of procedural norms, there are many problems in the implementation of the system of re-education through labor, and its legitimacy.Rationality and legitimacy have been questioned.In the face of a system of re-education through labour that has lasted for more than 40 years, it may not be possible to solve it by simply discussing the "legality" of the system. Legislation alone can only provide the formal "legitimacy" of the system.However, it does not necessarily solve the problem of "reasonableness" inherent in the system; simply declaring the end of the system of re-education through labour can only lead to a "satisfactory" result in the form of "re-education through labour".However, it is difficult to benefit from the protection of human rights and social stability and development.No matter how serious the problem of reeducation through labour is, it is only an appearance. The deep reflection of this phenomenon is how to restrict the public power of the state and how to ensure that the individual rights and freedoms are not infringed arbitrarily.From the historical point of view, the author makes a brief review of the emergence and changing process of the system of re-education through labor, analyzes the defects and problems of the system from the aspects of substance and procedure, and puts forward his own plan and opinions on the reform of the system of re-education through labor.
