信用卡诈骗罪及其防治对策

【摘要】：本文首先概括地介绍了信用卡的产生和发展进程,阐述了信用卡的转帐结算、储蓄、汇兑和消费信贷的四大基本功能,指出随着信用卡功能的不断发展以及信用卡在社会生活和经济活动中的不断渗透,信用卡诈骗犯罪也在与日俱增,惩治和防范信用卡诈骗犯罪成为世界各国共同面临的任务。国际上,各个国家和地区关于信用卡诈骗罪的立法状况有所差别,但是我国将信用卡诈骗罪从一般诈骗罪中分离出来则是完全必要的。文章中笔者对信用卡诈骗罪的概念及构成要件进行了详细的阐述,对学术界的各种观点加以分析论证,并理论结合实践对司法认定中的一些疑难问题进行深入探讨,提出自己的观点。同时,指出现行刑法中关于信用卡诈骗罪规定存在的一些缺陷和不足,为使之更好地与司法实践相适应,更有力地打击和预防信用卡诈骗犯罪,从增设单位犯罪主体和客观行为方式、取消有关条款、以及变更罪名等方面提出对信用卡诈骗罪立法完善的建议。文章还通过对信用卡诈骗罪的特点、成因进行全面分析,从宏观和微观两方面提出信用卡诈骗罪的防治对策,并结合笔者自身工作实践提出警方防控信用卡诈骗犯罪的相关对策。
[Abstract]:In this paper, the emergence and development process of credit card is introduced, and the four basic functions of credit card such as transfer settlement, savings, exchange and consumption credit are expounded.It is pointed out that with the continuous development of credit card function and the continuous penetration of credit card in social life and economic activities, the crime of credit card fraud is also increasing day by day. Punishing and preventing the crime of credit card fraud has become a common task of all countries in the world.Internationally, the legislative status of credit card fraud is different in different countries and regions, but it is absolutely necessary for China to separate the crime of credit card fraud from the general crime of fraud.In this paper, the author elaborates the concept and elements of the crime of credit card fraud, analyzes and demonstrates the various viewpoints of the academic circles, and probes deeply into some difficult problems in judicial cognizance by combining theory with practice.Put forward one's point of view.At the same time, the author points out some defects and deficiencies in the current criminal law on credit card fraud, in order to make it more suitable for judicial practice, and to combat and prevent the crime of credit card fraud more effectively.This paper puts forward some suggestions on how to perfect the legislation of credit card fraud from the aspects of setting up unit crime subject and objective behavior mode canceling the relevant clauses and changing the charge.Through the comprehensive analysis of the characteristics and causes of the crime of credit card fraud, the article puts forward the prevention and cure measures of the crime of credit card fraud from the macro and micro aspects.Combined with the author's own work practice, the author puts forward some countermeasures to prevent and control credit card fraud.
