宽严相济刑事政策视角下劳动教养制度改革研究

【摘要】: 劳动教养制度作为一项颇有争议的制度,存废问题又成为媒体关注的焦点问题。作为基层法律实务工作者,在多年的工作实践中,我们清醒地看到了劳动教养制度存在的必要性和重要性,劳动教养制度在教育、感化、挽救轻微违法犯罪人员,维护社会治安,有效预防和减少违法犯罪、教育和挽救轻微违法犯罪人员、稳定社会秩序,发挥了重要的作用。因此,旨在健全和完善劳动教养制度,改革劳动教养制度的实践与探索一直在不断进行。 宽严相济的刑事政策是在构建社会主义和谐社会中最大限度减少社会不合谐因素,最大限度缓解社会冲突,最大限度防止社会对立,有着非常重要的作用,对我国各法律实务部门,尤其是监狱、劳动教养机关也有着非常重要的指导意义和现实价值。 本文用宽严相济的刑事政策指导当前劳动教养制度改革,借鉴司法行政部门劳动教养立法构想与改革探索的一些成果,提出切实可行的改革措施与建议。 用宽严相济的刑事政策指导劳动教养制度改革,主要从四个方面着手:首先加快劳教立法进程,劳教立法向轻缓化发展。其次,在劳动教养执行程序中,积极推行开放式、半开放式、封闭式三种管理模式,着眼于从宽、从轻处罚,劳动教养执行可以向非监禁化和所外服教发展,劳动教养执行向社会化发展。另一方面,劳教所对劳教人员的所内管理向人性化发展,进一步保障劳教人员合法权益。此外,劳动教养执行机关还可以借鉴和参考国外矫治制度,探索社区矫治、所外服教等新方法、新途径,不断提高劳教人员教育挽救质量,为社会和谐稳定作出新贡献。
[Abstract]:As a controversial system, the issue of retention and abolition has become the focus of media attention.As legal practitioners at the grass-roots level, in years of work practice, we have clearly seen the necessity and importance of the existence of the system of re-education through labour. The system of re-education through labour is educating, influencing, and saving minor offenders.It has played an important role in maintaining public order, effectively preventing and reducing illegal crimes, educating and rescuing minor offenders and stabilizing social order.Therefore, the practice and exploration to perfect and perfect the system of reeducation through labor and reform the system of reeducation through labor has been going on all the time.The criminal policy of combining leniency with severity is to minimize social discord, minimize social conflicts, and prevent social antagonism to the maximum extent in building a harmonious socialist society, which plays a very important role.It also has very important guiding significance and practical value to every legal practice department of our country, especially to the prison and the re-education through labor institution.This paper uses the criminal policy of combining leniency and severity to guide the reform of the current system of re-education through labor, and draws lessons from some achievements of the legislative conception and reform exploration of the judicial administrative department of re-education through labor, and puts forward practical reform measures and suggestions.The reform of the reeducation through labor system should be guided by the criminal policy of combining leniency and severe punishment from four aspects: first, speeding up the legislative process of re-education through labor, and developing the legislation of re-education through labour to a light degree.Secondly, in the execution procedure of reeducation through labor, we should actively promote three management models, namely, open, semi-open and closed, with a view to leniency and leniency, so that the implementation of re-education through labor can develop towards non-imprisonment and out-of-service education.The implementation of reeducation through labor has developed towards socialization.On the other hand, the management of reeducation through labor centers is humanized, and the legitimate rights and interests of reeducation through labour are further protected.In addition, the executive organs of reeducation through labor can learn from and refer to foreign correctional systems, explore new methods and new ways of community correction and external service, and constantly improve the quality of reeducation through labor education and make new contributions to social harmony and stability.
