【摘要】：国内自20世纪90年代起至今,关于信息犯罪的研究工作尚处于混沌状态,学界甚至对信息犯罪的定义仍无定论。从研究起步阶段的计算机犯罪到之后的网络犯罪直至近年来的信息犯罪,各种定义和论述五花八门。笔者认为从信息技术视角出发,信息犯罪就是以信息法益,即信息管理秩序为客体的,或者说严重危害信息管理秩序的,应当受刑法处罚的行为。信息犯罪具有隐蔽性大,持续时间长;行为人年龄小、智商高;形式多样,覆盖面广;内外勾结,跨时空实施的特点。并且信息犯罪的发展呈手段趋多、成本趋低、影响趋广和规制趋难的态势。本文共分三章。第一章通过整理分析学界关于信息犯罪及类似概念:计算机犯罪、网络犯罪的各种学说,从信息管理视角分析其中存在的问题;阐述关键词:信息、信息管理秩序、信息法益;从而重新厘定本文所述信息犯罪的概念。第二章阐述信息犯罪的特点、发展趋势,并对三个信息犯罪热点事例进行分析,指出其中存在的问题,从中分别总结出“信息存储秩序”、“信息传播秩序”和“信息利用秩序”成为刑法法益的意义。第三章对信息犯罪从理论上做出分类,即按照信息流转环节对信息犯罪做出妨害信息存储、信息传播和信息利用秩序三种分类;并分别对其构成要件进行分析研究;进而从立法角度对信息犯罪的体系安置、罪状设置以及刑罚设置提出建议。
[Abstract]:Since 1990s in China, the research on information crime is still in a chaotic state, and the definition of information crime is still uncertain in academic circles.From the computer crime in the initial stage to the network crime in the later years and the information crime in recent years, there are various definitions and expositions.From the perspective of information technology, the author thinks that information crime is the behavior of taking information law benefit, that is, information management order as the object, or seriously endangering information management order, which should be punished by criminal law.Information crime has the characteristics of large concealment, long duration, small age, high intelligence quotient, various forms, wide coverage, collusion between inside and outside, and implementation across time and space.The development of information crime is characterized by more means, lower cost, wider influence and more difficult regulation.This paper is divided into three chapters.The first chapter analyzes the existing problems from the perspective of information management by sorting out and analyzing the academic theories on information crime and similar concepts: computer crime and network crime, and expounds the key words: information, information management order, information legal interests;In order to redefine the concept of information crime described in this paper.The second chapter describes the characteristics and development trend of information crime, and analyzes three hot information crime cases, points out the existing problems, and summarizes the "information storage order"."Information dissemination order" and "Information Utilization order" become the meaning of criminal law interest.The third chapter classifies the information crime theoretically, that is, according to the information flow link to make the information crime to obstruct the information storage, the information dissemination and the information utilization order, and separately carries on the analysis research to its constituent elements;From the legislative point of view, the system of information crime placement, crime settings and penalties are proposed.
