【摘要】： 世纪交替之际，毒患如洪水猛兽般肆虐人类。在正义与善良的抗争搏斗中，人们已经清晰地认识到毒品犯罪是严重威胁人类的毒瘤。毒品犯罪所造成的危害现在已引起了国际社会和世界各国的高度重视。据联合国卫生组织报告，每年至少有1000万人因吸毒而丧失正常的智力和能力，而死于吸毒的人数更是逐年递增。毒品犯罪给国家的政治、经济、文化各方面都带来了严重的影响。毒品是许多刑事犯罪的重要诱因，在毒品吸贩活动猖獗的地区，百分之六七十的刑事案件同毒品有关。不少吸毒成瘾者为了筹集毒资，不惜铤而走险地进行盗窃、抢劫、诈骗、贪污犯罪。“瘾君子”通常失去常人的道德水准和廉耻之心，为了强化及实际体会吸毒后精神及生理上的快感，多与嫖娼、卖淫、强奸、赌博等违法犯罪活动相关联。贩毒者为了尽快享受，也多出入黄色下流的娱乐场所、赌博场所肆意挥霍。贩毒集团间为争夺毒源、争霸市场而发生的火并、杀人、伤害事件也层出不穷。毒品泛滥在给一个国家带来沉重经济负担的同时，毒品犯罪的发展直接破坏了社会主义精神文明建设，阻碍了社会的进步，严重妨碍了我国社会秩序的稳定。在毒品犯罪中，贩卖毒品犯罪是最常见、社会危害性特别大的一类犯罪。如今，毒品的非法生产、需求以及贩运呈一种巨大规模的上升趋势。贩毒活动猖獗横行，犯罪分子为了躲避打击，采用了许多新的犯罪手段，可谓是花样百出。在司法实践中对贩卖毒品犯罪定罪量刑的许多方面仍存在着诸多的争议。这些现实性的问题都说明了如何更有效、及时、准确的惩治贩卖毒品犯罪分子，是摆在司法工作者面前一个需要认真对待的具实践意义的课题。因此，无论从理论上，还是从实践上对贩卖毒品犯罪进行深入的研究，都是必要且有着重要的意义的。凡此种种，正是作者选题和写作的目的。本文除了引言外，分为三个部分进行论证。作者首先比较全面地讲述了毒品的由来，贩卖毒品犯罪的历史发展，以及惩治贩卖毒品犯罪的立法及司法沿革；其次着重研究了贩卖毒品犯罪的概念、犯罪构成，以及罪与刑的认定和处罚的若干理论与实践问题；最后针对我国当前贩卖毒品犯罪的特点，简要分析了贩卖毒品犯罪的若干具体原因和防治对策。引言，首先用些客观的数据阐述了毒品犯罪的巨大危害性，进而引出了本文的主题——贩卖毒品犯罪的理论与实践。第一部分，贩卖毒品犯罪的历史、现状及立法沿革。分层论述了毒品的渊源及其发展；我国贩卖毒品犯罪的历史发展，其中包括清政府初期、旧中国、现阶段我国的 WP=5 贩卖毒品犯罪情况；当今世界各国贩卖毒品犯罪情况以及我国惩治贩卖毒品犯罪的立法沿革。通过这一部分的论述，让我们认识到贩卖毒品犯罪不是现时期才出现的，我国及世界上其它国家一起都将其作为惩治打击对象，进而认识到惩治此类犯罪的长期性、艰巨性。第二部分，贩卖毒品犯罪的罪与罚。分别论述了贩卖毒品犯罪的构成要件、犯罪形态、一罪与数罪问题、认定与刑罚适用中的若干问题，，比如毒品数量的计算、纯度的问题、共同犯罪问题、再犯及累犯的处罚问题等等，提出了解决的办法与论据。特别对于一些残疾人、绝症病人、高龄老人、间歇性精神病人等特定主体进行贩卖毒品犯罪时如何处理的问题，提出了自己的一些独立见解，从而使得对于贩卖毒品犯罪的惩处更为有力、充分和科学。第三部分，查禁贩卖毒品犯罪的对策研究。这一部分主要针对贩卖毒品犯罪巨大的社会危害性，从它的特点出发，分层论述了当前贩卖毒品犯罪严重的原因，我国在查禁此类犯罪中存在的困难，以及查禁其的对策。在查禁对策方面，笔者提出了六点自己的见解，有一定的现实意义。通过这一部分的论述，使我们清楚如何有效的对贩卖毒品犯罪进行打击和预防，并且积极行动起来，同贩卖毒品犯罪作斗争。
[Abstract]:At the turn of the century, the drug victims are raging human beings like a great beast. In the struggle between justice and kindness, people have clearly recognized that drug crime is a serious threat to human beings. The harm caused by drug crime has now aroused great attention from the international community and all the countries of the world. Less than 10 million people lose normal intelligence and ability because of drug use, and the number of people who die of drugs is increasing year by year. Drug crime has brought serious influence on the political, economic and cultural aspects of the country. Drugs are the important inducements of many criminal offences. In the areas where drug trafficking is rampant, sixty or seventy of the criminal cases are in the same case. Drugs are related. Many drug addicts do not hesitate to steal, robbery, fraud and embezzlement in order to raise poison. "Addicts" usually lose the moral standards and honesty of the ordinary people. In order to strengthen and realize the mental and physiological pleasure after taking drugs, they are often with illegal activities such as prostitution, prostitution, rape, gambling and so on. Drug traffickers, in order to enjoy themselves as soon as possible, are also more and more in and out of the entertainment places of yellow and downflow, and wanton gambling places are wantonly. The construction of socialist spiritual civilization has hindered the progress of society and seriously hindered the stability of our social order.
In drug crime, drug trafficking is one of the most common and social crimes. Nowadays, the illegal production, demand and trafficking of drugs are increasing in a huge scale. Drug trafficking is rampant. In order to avoid the attack, the criminals have adopted a number of new means of crime. There are still many controversies in many aspects of the criminal conviction and sentencing of drug trafficking. These realistic questions have shown how to effectively, timely and accurately punish drug trafficking criminals. It is a practical subject to be seriously treated in front of the judicial workers. Therefore, both in theory and from it, In practice, it is necessary and important to conduct in-depth research on drug trafficking crime. All these are the purpose of the author's topic selection and writing.
In addition to the introduction, this article is divided into three parts. The author begins with a comprehensive description of the origin of drugs, the historical development of drug trafficking, and the legislation and judicial evolution of punishing drug trafficking. Secondly, it focuses on the concept of drug trafficking, the constitution of the crime, and the identification and punishment of crime and punishment. Finally, in view of the characteristics of drug trafficking crime in China, some specific reasons and Countermeasures for drug trafficking crime are briefly analyzed.

In particular, some independent opinions on how to deal with drug trafficking are put forward to some special subjects such as the disabled, the elderly, the elderly and the intermittent mental patients, which make the punishment of drug trafficking more powerful, full and scientific.
The third part, the study of the measures to ban drug trafficking. This part mainly aims at the great social harmfulness of drug trafficking. From its characteristics, this part expounds the causes of the serious drug trafficking, the difficulties in the prohibit of such crimes and the measures to ban it. Six points of own opinion have some practical significance. Through this part of the discussion, we can make clear how to effectively combat and prevent drug trafficking and fight against drug trafficking.
