犯罪成本与犯罪控制成本分析

【摘要】：犯罪既是一个社会问题,也是一个经济问题。犯罪人犯罪需要投入一定的资源,国家和社会控制犯罪更是要付出沉重的代价。本文立足于犯罪学的基本理论,引入经济学中“成本”的概念,借助于经济分析的方法,从犯罪人的犯罪成本与国家、社会的犯罪控制成本的分析中,试图为如何有效地进行犯罪控制提供一种新的视角。本文共分为四个部分展开探讨:绪论、犯罪成本分析、犯罪控制成本分析、犯罪成本与犯罪控制成本的关系分析。首先,本文从为什么选择该课题入手,说明了研究的理论意义和实践价值,并提出了研究的理论前提——理性人。其次,本文从两个方面探讨了犯罪成本:一是犯罪成本的概念;二是犯罪成本的构成。笔者认为,要进行一项研究,首先必须明确相关概念的界定,由于关于犯罪成本概念的说法多种多样,笔者在对各种观点评析的基础上,从犯罪人主体性的角度对犯罪成本的概念进行了界定。所谓犯罪成本,是指犯罪人在进行犯罪决策、为犯罪做准备、实施犯罪过程中以及承担犯罪后果所必须要付出和可能要付出的物质性、非物质性以及法律性的代价的总和。也就是犯罪人因犯罪而在犯罪前、犯罪中、犯罪后所必须要付出和可能要付出的物质性、非物质性以及法律性的代价的总和。关于犯罪成本的构成,也有不同的观点,笔者认为,犯罪成本包括预期的犯罪成本与现实的犯罪成本,它们又都可以细化为物质性成本与非物质性成本两大类,由于法律是对抗犯罪的一种最重要的和有效的方式,犯罪人实施犯罪必然或者可能受到法律的惩处而要付出相应的代价,虽然犯罪的法律性成本也可以归属于犯罪的物质性成本或者犯罪的非物质性成本的范畴,但为了体现法律的重要性、有效性以及犯罪人因犯罪所需要付出的法律性成本的严重性,应该强调一下犯罪的法律惩处性成本。因此,犯罪成本由犯罪的物质性成本、犯罪的非物质性成本以及犯罪的法律惩处性成本构成。再次,本文从三个方面分析了犯罪控制成本:一是犯罪控制概述;二是犯罪控制成本的概念;三是犯罪控制成本的构成。犯罪控制就是适应犯罪的基本规律,把犯罪遏制在一定范围内或一定程度上的方法和手段。犯罪控制由犯罪系统和社
[Abstract]:Crime is not only a social problem, but also an economic problem. Criminals need to invest a certain amount of resources, and the state and society must pay a heavy price for crime control. Based on the basic theory of criminology, this paper introduces the concept of "cost" in economics, and by means of economic analysis, analyzes the cost of crime of the offender and the cost of crime control in the country and society. Attempts to provide a new perspective on how to effectively control crime. This paper is divided into four parts: introduction, analysis of crime cost, analysis of crime control cost, analysis of the relationship between crime cost and crime control cost. First of all, this paper explains the theoretical significance and practical value of the research from why we choose the subject, and puts forward the theoretical premise of the research-rational people. Secondly, this paper discusses the crime cost from two aspects: the concept of the crime cost and the composition of the crime cost. The author believes that in order to carry out a study, we must first define the relevant concepts. Because of the variety of views on the concept of crime cost, the author comments on the basis of a variety of views. This paper defines the concept of crime cost from the angle of criminal subjectivity. The so-called cost of crime refers to the sum of the material, non-material and legal costs that the offender has to pay and may pay in the course of carrying out the crime and undertaking the consequences of the crime in making criminal decisions, making preparations for the crime, and undertaking the consequences of the crime. That is, the sum of the material, non-material and legal costs that the criminal has to pay and may have to pay before and after the crime. There are also different views on the composition of crime cost. The author thinks that crime cost includes expected crime cost and real crime cost, which can be divided into two categories: material cost and non-material cost. Since the law is the most important and effective way to combat crime, the perpetrators must or may be punished by the law at a corresponding cost. Although the legal cost of a crime can also be attributed to the material cost of a crime or the non-material cost of a crime, in order to reflect the importance of the law, The validity and the seriousness of the legal cost of the criminal should emphasize the legal penalty cost of the crime. Therefore, the cost of crime consists of the material cost of crime, the non-material cost of crime and the legal punishment cost of crime. Thirdly, this paper analyzes the cost of crime control from three aspects: first, the overview of crime control; second, the concept of the cost of crime control; third, the composition of the cost of crime control.
