群体性事件政府信息公开制度研究

【摘要】：近年来，各种群体性事件频繁在我国发生，在社会上已经成为一种非常态中的常态。群体性事件频频发生，不仅会造成经济发展和社会秩序的破坏，损害公众的利益，而且也给政府的治理带来了严峻的挑战。因为基于对未知危险的本能恐惧，群体性事件中的公众有着获取政府真实信息的迫切需求，而这一过程中信息的缺失、偏颇、延误将导致公众的群体性恐慌，极易诱发更加严重的社会问题。因此政府及时公布各种相关信息，澄清事实真相，将问题和矛盾在第一时间向社会公众开放，才能使问题在最初阶段就得到解决。本文从政府信息公开这一视角出发来研究、探讨合理解决群体性事件的机制、体制，寻求各个利益群体之间的利益平衡点，减少利益冲突，减缓群体性事件对社会稳定造成的不良影响。研究群体性事件中政府履行信息公开的义务不仅是保障公民知情权、言论自由等权利的实现和依法行政、建设法治国家的必然要求，也是建立政府与民众良性沟通、互动机制的重要前提。本论文共分为五部分，第一部分主要是对群体性事件政府信息公开的概述，以群体性事件以及政府信息公开的概念界定、特点分析为出发点，分析两者之间的联系，以及群体性事件中的政府信息公开与其他普通的政府信息公开相比，，自身的特点和特殊之处；第二部分是从法的秩序、正义、效率的价值角度对群体性事件政府信息公开进行分析；第三部分是对美国、英国、日本在这一方面的规定做出研究和分析，与我国进行对比，以期对我国有所借鉴；第四部分主要包括目前我国群体性事件政府信息公开这一法律制度研究现状，从立法、学术理论、实践层面予以分析，进而总结出存在的问题；第五部分根据第二、三部分的研究，重点总结出解决上述问题的方法，并提出对策。
[Abstract]:In recent years, a variety of group events occurred frequently in China, which has become a kind of abnormal normal in the society. The frequent occurrence of mass events not only leads to the destruction of economic development and social order and damages the interests of the public, but also brings severe challenges to the governance of the government. Because of the instinctive fear of unknown dangers, there is an urgent need for the public in mass events to obtain the true information of the government, and the lack of information in the process, bias and delay will lead to mass panic among the public. It is easy to induce more serious social problems. Therefore, the government can release all kinds of relevant information in time, clarify the truth of the facts, open the problems and contradictions to the public at the first time, so that the problems can be solved in the initial stage. From the perspective of government information disclosure, this paper discusses the mechanism and system of reasonably resolving mass incidents, seeks the interest balance point among various interest groups, and reduces the conflicts of interest.
