【摘要】： 社区矫正是与监禁矫正相对的一种行刑方式，是西方发达国家实施犯罪改造的一种主要形式。2003年7月10日，最高人民法院、最高人民检察院、公安部、司法部联合颁布的《关于开展社区矫正试点工作的通知》(以下简称两院两部《通知》)和2004年了月1日生效的《司法行政机关社区矫正工作暂行办法》，标志着社区矫正制度在我国从理论研究走向了实践。随后，北京、上海、天津、浙江、江苏、山东等六省市开始了社区矫正的试点工作，现在，我国社区矫正试点已经扩大到18个省市。社区矫正在我国的推行，标志着我国刑罚执行制度的重大变革，也是我国目前构建和谐社会的一项基础性工作。为充分发挥社区矫正在我国构建和谐社会中的作用，笔者对国内外社区矫正的一些问题进行了研究，提出了完善我国社区矫正的一些想法。论文共分为四个部分。第一部分，社区矫正的概念及源起。首先，介绍了中外学者对社区矫正定义的阐述，分析了社区矫正的一些基本特征。其次，阐述了社区矫正理论的产生，，回顾了社区矫正制度的产生过程。第二部分，部分国家和地区的社区矫正实践及借鉴意义。首先从社区矫正的指导思想和理念，法律制度的制定，措施种类的设置以及矫正的执行等方面研究了英国、美国明尼苏达州、德国、日本的社区矫正实践，其次总结了国外的社区矫正的借鉴意义，包括法律制度比较健全，指导思想和理念比较先进，措施的种类设置比较全面、科学，政府部门、民间组织以及个人积极、广泛参与等。第三部分，社区矫正在我国和谐社会中的价值分析与现状评述。首先，分析了社区矫正在促进社会稳定、体现刑罚对犯罪人的人性化、以及在节约社会资源等方面的价值。其次，对我国社区矫正的现状进行了评述，指出目前在我国，对社区矫正措施的认识有待进一步提高；和国外相比较，我国的社区矫正措施适用面太窄；社区矫正的法律制度不健全；对犯罪人的权利保障不足；缺乏现代化的管理、矫正手段和方法。第四部分，建立有利于构建和谐社会的社区矫正制度的思考。结合我国的司法实践，从建立和完善社区矫正的法律制度；改革和完善社区矫正措施；加强社区矫正机构建设和队伍建设；拓展社区矫正试点工作的广度和深度，积极探索适合我国国情的社区矫正模式四个方面提出了一些建议意见。最后在结束语部分对全文进行一个扼要的概括，指出社区矫正是社会文明进步的标志，推行此项措施，不仅是刑罚执行制度的改革，更是预防和减少重新犯罪，维护社会长治久安，实现高度的政治文明和社会和谐的有效举措。同时指出，对社区矫正，我们要本着实事求是的原则，理论联系实践，吸收国外的先进经验，逐步完善和发展我国的社区矫正制度，充分体现社区矫正的积极作用，以促进社会的可持续和谐发展。
[Abstract]:Community correction is a form of execution opposite to that of imprisonment correction. It is a major form of criminal reform in western developed countries. On July 10, 2003, the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security, The Ministry of Justice jointly promulgated the Circular on the pilot work of Community Correction (hereinafter referred to as "the notice") and the "interim measures on Community Correction of Judicial Administration organs", which came into effect on January 1, 2004, marking the community. Correction system has moved from theoretical research to practice in our country. Subsequently, Beijing, Shanghai, Tianjin, Zhejiang, Jiangsu, Shandong and other six provinces began the pilot work of community correction. Now, the pilot project of community correction has been expanded to 18 provinces and cities. The implementation of community correction in our country marks a great change in the system of penalty enforcement in our country, and it is also a basic work of constructing a harmonious society in our country at present. In order to give full play to the role of community correction in building a harmonious society in our country, the author studies some problems of community correction at home and abroad, and puts forward some ideas to perfect the community correction in our country. The thesis is divided into four parts. The first part, the concept and origin of community correction. Firstly, it introduces the definition of community correction and analyzes some basic characteristics of community correction. Secondly, it expounds the emergence of community correction theory and reviews the emergence process of community correction system. The second part, some countries and regions of the practice of community correction and reference significance. First of all, the paper studies the practice of community correction in Britain, Minnesota, Germany and Japan from the aspects of the guiding ideology and concept of community correction, the formulation of legal system, the setting of measures and the implementation of correction. Secondly, it summarizes the reference significance of community correction in foreign countries, including relatively sound legal system, advanced guiding ideology and concept, comprehensive set of measures, scientific, government departments, civil organizations and individuals active. Extensive participation, etc. The third part, the value analysis and current situation of community correction in harmonious society of our country. Firstly, it analyzes the value of community correction in promoting social stability, embodying the humanization of punishment to criminals and saving social resources. Secondly, the current situation of community correction in China is reviewed, and it is pointed out that the understanding of community correction measures needs to be further improved in our country, and compared with foreign countries, the application of community correction measures in our country is too narrow. The legal system of community correction is not perfect, the protection of the rights of the offenders is insufficient, and the modern management, correction means and methods are lacking. The fourth part, the establishment of community correction system conducive to the construction of a harmonious society. Combining with our country's judicial practice, we should establish and perfect the legal system of community correction, reform and perfect the measures of community correction, strengthen the construction of community correction institution and team, expand the breadth and depth of the pilot work of community correction. Four aspects of community correction model suitable for China's national conditions are actively explored and some suggestions are put forward. Finally, in the concluding part, the author summarizes the whole text briefly, and points out that community correction is the symbol of the progress of social civilization. The implementation of this measure is not only the reform of the penalty enforcement system, but also the prevention and reduction of recidivism. Maintain long-term social stability and achieve a high degree of political civilization and social harmony effective measures. At the same time, it is pointed out that for community correction, we should follow the principle of seeking truth from facts, integrate theory with practice, absorb advanced experience from abroad, gradually perfect and develop the community correction system of our country, and fully reflect the positive role of community correction.
