【摘要】：拐卖人口犯罪是一种严重侵犯人身权利的犯罪,也是当前一个全球性的严重问题。当今世界各国无不将拐卖人口犯罪作为严重侵犯人身权和人格尊严的犯罪, 并在刑法中加以规定。中国政府一贯重视对拐卖人口犯罪的惩治和打击,到 20 世纪 60 年代,拐卖人口现象在中国大陆已经基本绝迹,但随着社会和经济的发展, 拐卖人口犯罪又死灰复燃,自 20 世纪 70 年代开始,我国的拐卖人口犯罪呈上升趋势。特别是 20 世纪 90 年代以来,由于各地经济发展的不平衡以及人们社会生活贫富之间差距的加大,拐卖人口犯罪在数量上有增无减,并呈现出许多新型的特点。本文除导言和后记外,共分四部分,约 37,000 字,其中脚注 2400 余字。第一部分是对拐卖人口犯罪的综合论述。文章阐述了拐卖人口犯罪的定义和我国关于拐卖人口罪的法律规定,考察了世界各国和地区拐卖人口犯罪的历史、现状及特点,并重点对当代中国拐卖人口的现状及特点进行了系统论述。第二部分描述了当代中国拐卖人口犯罪的基本特征。文章认为,拐卖人口犯罪的行为特征主要体现为动机的贪利性、手段的多样性、行为的持续性、地域的特定性、时间的趋时性等,并从拐卖人口犯罪的主体特征、被害人特征、收买主体特征等方面对拐卖人口犯罪其他基本特征进行了详细的分类、归纳。 WP=4 第三部分系统地研究了当代中国拐卖人口犯罪的形成原因。文章认为,古代社会传统的婚嫁制度、封建主义思想观念、传宗接代的人性本能以及私有制构成了拐卖人口犯罪的历史因素,经济发展的失衡、法制观念的淡薄、防控机制的弱化、买方市场的推动以及跨国贩卖的渗透构成了当代中国拐卖人口犯罪的现实因素,而犯罪者的因素、被害人的被害性以及“买主”的原因则构成了当代中国拐卖人口犯罪的个体因素,并进一步指出贫穷和财富分配不均、性产业的繁荣和婴儿低出生率、巨额的利润刺激以及法律不健全,打击不力是当代国际拐卖人口犯罪盛行的主要原因。第四部分主要论述当代中国拐卖人口犯罪的预防对策。文章认为,应从社会的、法律的、组织的、个人的等方面对当代中国拐卖人口犯罪进行预防,并提出了一些富于建设性的对策。
