略论西汉对犯罪的预防与惩治

【摘要】： 古往今来，犯罪一直是困扰人类发展的严重社会问题，，有关治理犯罪的理论和对策的研究向来为人所重视。中国是世界上公认的犯罪率较低的国家之一，这与古代先贤摸索出了一套控制犯罪的成功经验有着密切关系。西汉是中国封建社会治理犯罪基本模式的奠基时代，可是关于这一时期对犯罪的预防与惩治，迄今为止尚无专门系统的研究成果问世。有鉴于此，本文在前人研究的基础上，力求利用传世文献、出土文献及其它相关成果，尝试对西汉预防与惩治犯罪的基本情况作一初步的整理和分析。全文由前言、第一至第五章及结语组成。前言主要阐述了中国古代预防与惩治犯罪的理论对策及理论价值，论证了本论题的研究意义，并对研究现状、研究的重点与难点作了简要说明，强调历史发展到今天，我国古代治理犯罪的成功经验仍有一定的生命力，值得认真借鉴。第一章重点揭示了西汉时期治理犯罪指导思想的根本转变，指出统治者吸取秦亡的教训，从国家长治久安的战略高度出发，适应当时社会的历史特点，逐步确立了以礼义教化为基点，全方位、多渠道防治犯罪的基本格局，这是西汉王朝得以长期稳定发展的重要原因。第二至第五章分别介绍了当时政治性犯罪、官吏职务犯罪、财产犯罪、人身犯罪的简单概况，全面剖析了西汉预防与惩治犯罪的网络系统的建构及各项措施的推行，说明预防为主、标本兼治，整体布局、综合为治的指导思想在西汉时期发挥了积极的影响，为缓解社会矛盾的激化，减少大规模、普遍性的犯罪发生，起了有利的推动作用，体现了统治经验的成熟。结语客观评价了西汉治理犯罪基本方略的历史地位和影响，认为它虽然不可避免地带有严重的局限性，但仍然是我国丰富的历史文化宝库中一笔珍贵的法律文化遗产。
[Abstract]:Since ancient times, crime has been a serious social problem puzzling the development of human beings. China is recognized as one of the countries with low crime rate, which is closely related to the successful experience of ancient sages in crime control. The Western Han Dynasty was the foundation of the basic pattern of crime control in feudal society of China, but there was no systematic research result on the prevention and punishment of crime in this period. In view of this, on the basis of previous studies, this paper tries to make a preliminary arrangement and analysis of the basic situation of the prevention and punishment of crime in the Western Han Dynasty by making use of the handed down documents, unearthed documents and other relevant achievements. The full text consists of preface, first to fifth chapters and conclusion. The preface mainly expounds the theoretical countermeasures and theoretical value of the prevention and punishment of crime in ancient China, demonstrates the significance of the research on this topic, and briefly explains the present research situation, the key points and difficulties of the research, and emphasizes that the history has developed to today. The successful experience of controlling crime in ancient China still has certain vitality, which is worthy of reference. The first chapter focuses on revealing the fundamental transformation of the guiding ideology of crime management in the Western Han Dynasty, pointing out that the rulers learned from the lessons of Qin Dynasty and adapted to the historical characteristics of the society at that time from the strategic height of long-term stability of the country. The basic pattern of crime prevention and control in all directions and through various channels was gradually established, which was the important reason for the long-term and stable development of the Western Han Dynasty. The second to fifth chapters respectively introduced the political crime, the official duty crime, the property crime, the personal crime simple general situation, comprehensively analyzed the Western Han Dynasty to prevent and punish the crime network system construction and the implementation of the various measures. It is shown that the guiding ideology of prevention, treatment of both symptoms and symptoms, overall layout and comprehensive treatment played a positive role in the Western Han Dynasty, and played a favorable role in alleviating the aggravation of social contradictions and reducing the occurrence of large-scale and universal crimes. It reflects the maturity of the ruling experience. The conclusion objectively evaluates the historical position and influence of the basic strategy of crime control in the Western Han Dynasty, and considers that it is still a precious legal and cultural heritage in the rich historical and cultural treasure-house of our country, although it inevitably has serious limitations.
