当前“黑车”整治政策的缺陷及完善研究

【摘要】:改革开放以来,随着经济的迅速发展,城市迅速扩大。伴随着城市的迅速扩张,城市交通运输供给日趋紧张,城市客运出现了供需失衡的局面,于是“黑车”应运而生。当前“黑车”已经成为我国许多城市交通运输的软肋,严重扰乱了市场正常的运营秩序,不仅侵害了合法经营者的利益,而且影响了城市形象。近年来,虽然各城市政府出台了相关整治城市“黑车”的相关政策,各城市交通运管部门也相继开展了整治“黑车”的行动,但是相关问题并没有得到解决,我们看到的是有些政府为了整治“黑车”不惜“钓鱼执法”,甚至出现违法行为。目前,“黑车”依然泛滥,且有愈演愈烈之势。因此,找到“黑车”产生的根源,进而分析政府在整治城市“黑车”中存在的问题,解决政府在整治“黑车”中所遇到的困境,对规范城市正常的客运市场秩序以及维护城市安全和形象都有着重要意义。 本文以政府整治城市“黑车”出台的政策为研究对象,结合实地访谈,以探寻“黑车”存在的机理为突破点,运用市场供求理论、博弈理论、动机理论以等理论对“黑车”存在的机理进行分析。同时分析城市“黑车”存在的内部原因和外部原因,认为当前“黑车”屡治不绝,与政府整治城市“黑车”出台的各项政策有直接的联系。文章认为政府为整治城市“黑车”而出台政策在政策制定、政策执行、和政策制定中都存在一定的缺陷,当前的“黑车”整治政策目标不清、政策缺乏操作性和公共性,在执行中由于地方政府以及其他利益团体的层层阻挠,政策难以执行。另外政策监督缺失,导致违法行为屡见不鲜,损害了政府的权威。本文分析了政策制定、政策执行以及政策监督存在问题的原因,提出了完善现有整治政策的建议,认为政府应该重构政策问题、重建政策目标、重构管制政策,加大政策执行和监督的力度,进而从根本上肃清“黑车”。
[Abstract]:Since the reform and opening up, with the rapid development of the economy, with the rapid expansion of the city, with the rapid expansion of the city, the supply and supply of urban transportation is becoming increasingly tense, and the imbalance of supply and demand has emerged in urban passenger transport, so the "black car" emerges as the times require. The current "black car" has become a soft rib of many cities in China, and seriously disrupts the market. The normal operation order not only infringes on the interests of the legal operators, but also affects the city image. In recent years, although the relevant policies of the urban "black car" have been issued by various urban governments, the traffic management departments of each city have also carried out the action of the "black car", but the related problems have not been solved, we see At present, the "black car" is still overflowing, and there is a growing trend. Therefore, to find the root of the "black car", and then analyze the problem that the government has saved in the city "black car", to solve the government in the "black car" in the encounter. The predicament is of great significance to normalize the normal order of passenger transport market and safeguard the safety and image of the city.
In this paper, based on the policy of government regulation of city "black car" as the research object, in order to explore the mechanism of "black car" as a breakthrough point, the mechanism of the existence of "black car" is analyzed with the theory of market supply and demand, game theory and motivation theory, and the internal reasons for the existence of "black car" in city are analyzed. The article holds that the government has some defects in policy making, policy implementation and policy making, and the current policy goal of "black car" regulation is not the goal. The policy is not operational and public, and the policy is difficult to carry out in the implementation of the local government and other interest groups. In addition, the lack of policy supervision leads to the violation of the illegal behavior and the authority of the government. This paper analyses the reasons for the problems of policy making, policy implementation and policy supervision, and puts forward the reasons for the problems. The suggestion of improving the existing regulation policy is that the government should reconstruct the policy problem, rebuild the policy goal, reconstruct the control policy, increase the enforcement and supervision of the policy, and then eliminate the "black car" fundamentally.
