中国劳动教养制度研究兼论劳动教养的出路

【摘要】： 劳动教养制度是我国特定历史条件创设的一种法律制度。我国劳动教养制度的发展大致经历了创设阶段、发展阶段、被破坏阶段和恢复与改革发展阶段；劳动教养的社会功能也相应的由最初的安置就业过渡到目前的维护社会治安秩序。我们不能否认这一制度在中国社会曾经起到过的积极作用，但随着法制化进程的推进和依法治国方略的实施，这一制度的不合理性日益凸现，在中国存在了将近50年的劳动教养制度正面临着被质疑、批评、改革乃至于废弃的命运。本文在全面考察劳动教养制度的法制历程的基础上；比较研究了中西方相关法律制度；较为深入地分析了劳动教养制度的法律缺陷，同时也阐明了劳动教养制度今后的走向。从总体上说，本文由四个部分组成。首先，按照历史发展过程，全面考察了劳动教养的法制历程；其次，比较研究中国劳动教养制度与国外保安处分制度；再次，从实体法、证据法和程序法的角度分析劳动教养制度的法律缺陷；最后，提出科学的解决办法，指明劳动教养制度的未来发展趋势。
[Abstract]:The system of reeducation through labor is a kind of legal system created under the special historical conditions of our country. The development of our country's reeducation through labor system has experienced the stage of creation, the stage of development, the stage of destruction, the stage of restoration and reform and the stage of development. The social function of reeducation through labor is also corresponding to the transition from the initial placement and employment to the maintenance of social order. We cannot deny that this system has played a positive role in Chinese society, but with the advancement of legalization and the implementation of the strategy of governing the country according to law, the irrationality of this system has become increasingly apparent. The reeducation through labor system, which has existed in China for nearly 50 years, is facing the fate of being questioned, criticized, reformed and even abandoned. On the basis of a comprehensive investigation of the legal process of the system of re-education through labor, this paper compares the relevant legal systems between China and the West, and analyzes the legal defects of the system of re-education through labor in depth, and at the same time expounds the future trend of the system of re-education through labor. On the whole, this paper consists of four parts. First of all, according to the historical development process, a comprehensive review of the legal process of re-education through labour; secondly, a comparative study of China's re-education through labour system and foreign security measures system; again, from the substantive law, This paper analyzes the legal defects of the system of re-education through labor from the point of view of evidence law and procedural law, and finally, puts forward scientific solutions and points out the future development trend of the system of re-education through labor.
