美国青少年“管制物质”滥用犯罪若干重要理论问题简析

【摘要】：当今美国司法体系为应对国内青少年因普遍的物质滥用所导致的严重犯罪等社会问题设立了专门的青少年毒品法庭,而对于这一司法举措的利弊分析需要建立在若干前提概念的厘定与分析基础之上,如易滥用物质的界定,特别与传统毒品之间的关系;与物质相关的犯罪与传统毒品犯罪的关系;与专门毒品法庭的运作机制与绩效评价标准等。只有从对药品滥用的前提批判入手,才有可能从一个较为客观的视角对美国青少年药品滥用问题的现状、成因以及对策这一动态过程以及相关的经验教训加以明析。
[Abstract]:Today, the judicial system in the United States has set up special juvenile drug courts to deal with social problems such as serious crime caused by widespread substance abuse among young people in the country. The analysis of the advantages and disadvantages of this judicial measure needs to be based on the determination and analysis of several premise concepts, such as the definition of vulnerable substances, especially the relationship with traditional drugs; The relationship between the material related crime and the traditional drug crime, the operation mechanism and the performance evaluation standard of the special drug court. Only by criticizing the premise of drug abuse, it is possible to analyze the current situation, causes and countermeasures of drug abuse among young people in the United States from an objective angle of view.
