我国劳教制度中的人权保护

【摘要】: 劳动教养制度是一项独具中国特色的重要司法制度。在过去近50年的实践中发挥了重要作用。但由于该制度自身的缺陷,,其在人权保护方面存在诸多问题,需在今后立法中加以修正。本文第一章对我国劳教制度进行了回顾,提出了应保留该制度并对其进行司法化的观点。第二章阐明了我国人权的基本内容和对人权问题的基本立场及世界范围内对人权的态度。第三章阐述了我国劳教制度对人权的保护,分析了人权保护的意义;劳教与人权的辩证关系;劳教中人权的宪政基础;劳教中人权的主体,形式,最后提出了对进入劳教流程的人的权利保护设想。 通过解决上述几个问题,才能夯实劳教立法中确保人权的“四大支柱”:即立法和法理学上的法治化支柱;制度设计上的宪政支柱;处罚体系设计上的实体法支柱;处罚适用上的程序法支柱。为实现人权的保护打下一定的理论基础。
[Abstract]:The system of reeducation through labor is an important judicial system with Chinese characteristics. In the past 50 years of practice has played an important role. However, due to the defects of the system itself, there are many problems in the protection of human rights, which need to be amended in the future legislation. The first chapter reviews the system of reeducation through labor in China, and puts forward the point of view that the system should be retained and judicialized. The second chapter expounds the basic content of human rights in China, the basic position on human rights and the attitude towards human rights in the world. The third chapter expounds the protection of human rights in China's re-education through labour system, analyzes the significance of the protection of human rights, the dialectical relationship between re-education through labour and human rights, the constitutional basis of human rights in re-education through labour, the subject and form of human rights in re-education through labour. Finally, it puts forward the idea of protecting the rights of the people who enter the process of re-education through labor. Only by solving the above several problems, can we consolidate the "four pillars" of ensuring human rights in the legislation of re-education through labour: namely, the pillar of legalization in legislation and jurisprudence; Constitutional pillar in system design; substantive law pillar in punishment system design; procedural law pillar in punishment application. To lay a theoretical foundation for the protection of human rights.
