广州市社区矫正制度完善研究

【摘要】：社区矫正制度研究是当前我国政治生活及法学研究领域的一个新兴课题,是中国司法制度改革的重要组成部分。广州2006年启动社区矫正试点以来,矫正工作取得了一定成绩,为维护当地社会稳定、防止五类罪犯重新犯罪作出了贡献。但是,社区矫正作为新生事物在实践中存在这样那样的问题仍需完善。本文从社区矫正的利弊着手分析,以本土案例为着眼点,深入剖析广州社区矫正存在的主要问题。这些问题包括法律依据缺乏、执行主体不一致、队伍专业性不强、“人户分离”现象较严重、未成年犯社区矫正手段单一、人身危险性评估仍未起步等六个方面,有些问题是广州特有的,有些问题带有全国普遍性。结合广州实际,本文提出了完善立法、建立社区矫正专业化队伍、人户分离服刑人员的监管、全面启动人身危险性评估和完善青少年社区矫正五方面对策。立法完善方面主要是要在修改刑法等配套法律的基础上,出台专门的社区矫正法,对社区矫正法律性质和执行程序进行明确和规范。队伍专业化主要是建立专门的社区矫正官。解决人户分离问题主要是加强户籍地和居住地联动合作的问题。广州需全面启动人身危险性评估,本人对评估的定量分析进行了具体阐述。
[Abstract]:The study of community correction system is a new issue in the field of political life and legal research in China. It is an important part of the reform of China's judicial system. Since Guangzhou started the pilot of community correction in 2006, the correction work has made certain achievements, which has contributed to the maintenance of local social stability and the prevention of the re crime of the five types of criminals. The community correction as a new thing in practice still needs to be improved. This article analyzes the advantages and disadvantages of the community correction, taking the local cases as the eye point, and deeply analyzes the main problems of the community correction in Guangzhou. These problems include the lack of legal basis, the inconsistency of the executive body, the poor professionalism of the team, and the "human household". The phenomenon of "separation" is more serious, the means of community correction for juvenile offenders is single, and the assessment of personal danger is still not started in six aspects. Some problems are unique in Guangzhou and some problems are universal in China.
Combined with the reality of Guangzhou, this paper puts forward the five aspects of perfecting the legislation, establishing the professional team of community correction, the supervision of the separation of the prisoners by the people, starting the personal danger assessment and improving the community correction of the young people. The main part of the legislation is to introduce a special community correction law on the basis of modifying the law of the matching of criminal law and other laws. The legal nature and implementation procedures of community correction are clarified and standardized. The specialization of the team is mainly to establish a special community correctional officer. To solve the problem of household separation, the main problem is to strengthen the joint cooperation between the household register and the residence. Guangzhou needs to start the assessment of personal danger in an all-round way, and I elaborate the quantitative analysis of the assessment.
