【摘要】：我国大陆地区在经历25年(1953～1978)的历史空白之后，具有大陆地区特色的黑社会性质犯罪死灰复燃。一方面，境内黑社会性质犯罪的孳生；另一方面，境外黑社会的渗透，这两股黑社会势力在大陆地区以其特有的有组织暴力的超犯罪能量严重破坏了一地区或行业的经济和社会生活秩序，动摇了社会群体对国家的信任，给公众心理上造成一种邪恶当道，正义不存的错觉。因此，打击黑社会性质犯罪成为我国刑侦的重要迫切的任务之一。为了更有效地打击黑社会性质犯罪，本文将深入探讨黑社会性质基本理论以及打击黑社会性质犯罪的侦查对策，以期对刑侦工作有所启发。本文共分三部分，约35，000字。第一部分：概述。本部分从不同侧面探讨了两组概念：黑社会性质组织和黑社会性质犯罪。并且进一步区分了两组概念：黑社会性质组织和黑社会组织，黑社会性质组织与犯罪集团、犯罪团伙。第二部分：介绍当代中国(大陆地区)黑社会性质犯罪的基本特点。本部分着重从我国大陆地区黑社会性质犯罪的手段的残暴性，组织形式的落后性，成员结构的边沿性，组织活动的地域性，境外黑社会的渗透性，保护伞的地域性六个方面介绍我国大陆地区黑社会性质犯罪的特点。第三部分：我国黑社会性质犯罪侦查对策。本部分着重从五个方面探讨反黑对策，，即反黑领导机制的建立，反黑专业小组的建立，反黑证据收集，秘密侦查手段的合理运用以及反黑国际合作。
[Abstract]:After 25 years (19531978) of historical blank in the mainland of China, the underworld crime with the characteristics of the mainland has come back to life. On the one hand, the growth of triad crimes in the territory; on the other hand, the infiltration of underworld societies abroad, These two underworld forces in the mainland have seriously damaged the economic and social order of a region or an industry and shaken the trust of social groups in the state with their unique energy of super criminal organized violence. To the public psychologically create an evil situation, justice does not exist in the illusion. Therefore, cracking down on underworld crimes has become one of the important and urgent tasks of criminal investigation in China. In order to crack down on the crime of underworld character more effectively, this article will deeply discuss the basic theory of underworld nature and the investigation countermeasure of cracking down on underworld crime, in order to enlighten the work of criminal investigation. This article is divided into three parts, about 35000 words. Part I: Overview. This part discusses two groups of concepts from different aspects: underworld organization and underworld crime. And further distinguish two groups of concepts: underworld organization and underworld organization, underworld organization and criminal group, criminal gang. The second part: introduces the basic characteristics of the underworld crime in contemporary China (mainland China). This part focuses on the cruelty of the means, the backwardness of the organizational form, the edge of the membership structure, the regional nature of the organization activities, and the penetration of the overseas underworld in the mainland of China. The regional nature of umbrella introduces the characteristics of underworld crime in mainland China. The third part: our country underworld nature crime investigation countermeasure. This part focuses on five aspects of anti-triad countermeasures, namely, the establishment of anti-triad leadership mechanism, the establishment of anti-triad professional group, anti-criminal evidence collection, the rational use of secret investigative techniques and anti-criminal international cooperation.
