【摘要】：随着我国市场经济的发展、社会的文明进步和民主法治思想的深入人心，现代行政理念要求行政机关摆脱传统行政那种单纯依靠强制手段进行管理的模式，行政相对人也希望行政机关能提供更多的公共服务与社会援助。如何创新和实践新型的、有效的行政管理方式是各国政府面临的普遍性课题。实践证明，强制仅仅是保障社会规范效力的手段，行政机关不可能依靠强制力实现其全部目的。由于强制性行政行为本身存在的历史缺陷与弊端，顺应历史的潮流，非强制性行政行为理论应运而生。警察机关作为国家行政机关的重要组成部分，是国家暴力机器的典型代表。在新的时代背景下，警察机关在继续履行其固有的打击刑事犯罪，惩治违法行为的职责以外同样需要转变行政理念，履行好为行政相对人提供服务的社会职能。在我国，非强制性警察行政行为还处于研究的初级阶段，但非强制性行政行为的理念、价值、意义已经为世人所认可。积极研究适合我国国情的非强制性警察行政行为理论和制度，已经成为目前我国行政法理论界与实务界的重要课题。基于此，本文选择非强制性警察行政行为作为研究对象，试图从非强制性行政行为的基本原理入手，，通过对我国非强制性警察行政行为具体表现的介绍，分析我国目前非强制性警察行政行为存在的问题，进而提出发展和完善的途径。
[Abstract]:With the development of market economy in our country, the civilization and progress of society and the thought of democracy and the rule of law are deeply rooted in the hearts of the people. The modern administrative concept requires the administrative organs to get rid of the mode of traditional administration, which simply relies on coercive means for management. Administrative counterpart also hopes that the administration can provide more public services and social assistance. How to innovate and practice new and effective administrative methods is a universal task facing governments. Practice has proved that coercion is only a means to ensure the effectiveness of social norms, and administrative organs can not rely on coercive force to achieve all its purposes. Due to the historical defects and drawbacks of compulsory administrative act, the theory of non-compulsory administrative act emerges as the times require. As an important part of the state administration, the police is a typical representative of the national violence machine. Under the background of the new era, the police organs need to change the administrative concept and perform the social function of providing service to the administrative counterpart in addition to continuing to carry out their inherent duties of cracking down on criminal crimes and punishing illegal acts. In our country, the non-compulsory administrative behavior of police is still in the initial stage of study, but the concept, value and significance of the non-compulsory administrative act have been recognized by the world. It has become an important subject in the field of administrative law theory and practice of our country to actively study the theory and system of non-compulsory police administrative behavior which is suitable for the national conditions of our country. Based on this, this paper chooses the non-compulsory police administrative behavior as the research object, attempts to start with the basic principle of the non-mandatory administrative act, through the introduction of the concrete performance of the non-mandatory police administrative act in our country. This paper analyzes the problems existing in the administrative behavior of non-compulsory police in our country at present, and then puts forward the way to develop and perfect.
