社区矫正视角下的我国假释制度研究

【摘要】：假释是行刑社会化的一项重要制度,在世界各国的刑罚执行的实践中有着很高的适用率。2003年7月,我国首次明确将假释的犯罪分子列为社区矫正的对象之一。在实行试点后,由于各种原因,对假释罪犯的社区矫正也不尽理想,存在各种问题。因此,以社区矫正为视角重新审视我国的假释制度,对于促进假释制度的完善发展,具有重大的意义。笔者以假释和社区矫正的基本理论为出发点,介绍了中外假释制度的历史演变和发展现状,通过对中外假释罪犯的社区矫正适用的比较,指出我国假释社区矫正理论研究与实践和发达国家相比存在的各种问题,进而对改革和发展我国假释制度提出了一些有针对性的设想,以期完善我国假释罪犯的社区矫正制度。本文的创新点有：1、目前国内以社区矫正为视角探讨假释制度完善问题研究不多。以社区矫正为视角研究假释制度,不仅仅针对假释犯的监督考察,还包括对假释犯的矫正、教育和改造。2、本文以假释罪犯的社区矫正应用问题为切入点,具体分析在社区矫正过程中应完善的各项制度和措施,尤其是对假释犯在社区矫正过程中的人格调查和危险预测制度、改造和教育假释罪犯的各种举措等方面进行详细地论述,对假释罪犯社区矫正制度的完善提出了自己的见解。
[Abstract]:Parole is an important system of socialization of execution and has a high rate of application in the practice of penalty execution in various countries in the world. In July 2003, criminals on parole were explicitly listed as one of the objects of community correction in our country for the first time. After the trial, community correction of parolee criminals is not ideal because of various reasons. Therefore, it is of great significance to re-examine the parole system in China from the perspective of community correction. Based on the basic theories of parole and community correction, the author introduces the historical evolution and development of parole system in China and abroad. This paper points out the problems existing in the theoretical research of parole community correction in China compared with the practice in developed countries, and then puts forward some targeted ideas for the reform and development of parole system in China, with a view to perfecting the community correction system of parole criminals in China. The innovation of this paper is: 1. At present, there are few researches on the perfection of parole system in China from the perspective of community correction. To study parole system from the perspective of community correction, not only the supervision and investigation of parole offenders, but also the correction, education and reform of parole offenders. This paper takes the application of community correction of parolee criminals as the starting point. The system and measures that should be perfected in the process of community correction are analyzed in detail, especially the personality investigation and risk prediction system of parole offenders in the process of community correction, and various measures to reform and educate parolee criminals, etc. The author puts forward his own opinion on the perfection of community correction system of parolee criminals.
