犯罪研究的方法论反思与重构

【摘要】：科学史告诉我们,进行任何科学理论研究,都离不开一定的方法论原则,科学研究常常伴随着方法之争与方法之进步而进步。然而,方法论问题在我国社会科学领域一直未得到应有的重视。在犯罪研究方面,无论是犯罪学界还是刑法学界,都有学者指出学科的幼稚在很大程度上要归咎于研究方法的幼稚。本文的基本宗旨就是从方法论的角度,对犯罪研究的历史和现状予以深刻的反思和检讨,并从根本上发现我国目前犯罪研究中存在的问题,在此基础上重构犯罪研究的科学的方法论体系。论文首先从一般方法论出发,在历史唯物主义认识论的基础上,认为犯罪研究的方法论体系应当是以历史唯物主义的哲学分析为基础,实证分析和规范分析并存的体系结构。论文第二章通过反思犯罪研究的历史,指出犯罪古典学派和犯罪实证学派的哲学方法论基础虽然都是唯心主义的,但前者在其后来的历史发展中形成的规范分析方法契合了法律科学的形式和规范逻辑分析的要求,直接促进了统一的刑法学体系的形成;后者将实证分析引入犯罪研究中,使犯罪学从刑法学中独立出来,为科学地揭示犯罪现象的发生、发展规律提供了可能。在第三章,论文对我国犯罪研究的现状进行了检讨,分析了犯罪概念之争中体现的分析方法的混乱,以及犯罪学中犯罪实证研究之不足和刑法学中犯罪研究对规范分析的背离。论文最后认为要构建刑事法治理论,在犯罪研究的方法论上,任务有三,一是通过历史唯物主义的分析,在揭示犯罪的本体属性的基础上确立起符合现代法治要求的刑法精神和原则;二是通过犯罪学对犯罪现象的实证分析,获得对犯罪原因、及其发生、发展规律的科学认识,为刑事立法科学化和合理化提供理论根据和经验证明;三是坚持刑法学领域内犯罪研究的规范分析,为刑事司法客观化提供理论指导和技术支持。
[Abstract]:The history of science tells us that any research of scientific theory can not be separated from certain principles of methodology. However, methodology has not been given due attention in the field of social science in China. In the field of crime research, whether in the field of criminal law or in criminal law, some scholars point out that the childish nature of the subject is largely attributed to the infantility of the research methods. The basic purpose of this paper is to make a profound reflection and review on the history and present situation of crime research from the perspective of methodology, and to find out fundamentally the problems existing in the present crime research in our country. On this basis, it reconstructs the scientific methodology system of crime research. Starting from the general methodology and on the basis of historical materialism epistemology, this paper holds that the methodological system of crime research should be based on the philosophical analysis of historical materialism, with the coexistence of empirical analysis and normative analysis. In the second chapter, by reflecting on the history of crime research, the author points out that the philosophical methodology foundation of classical crime school and crime positivist school is idealistic. However, the normative analysis method formed by the former in its later historical development accords with the requirements of the form of legal science and normative logic analysis, and directly promotes the formation of a unified criminal law system, while the latter introduces empirical analysis into the study of crime. Making criminology independent from criminal law provides the possibility for revealing the occurrence and development law of crime phenomenon scientifically. In the third chapter, the thesis reviews the present situation of the crime research in China, analyzes the confusion of the analytical methods embodied in the debate on the concept of crime, and the deficiency of the empirical study of crime in criminology and the deviation from the normative analysis of the crime research in the criminal law. Finally, the thesis holds that to construct the theory of criminal rule of law, there are three tasks in the methodology of criminal research: first, through the analysis of historical materialism, On the basis of revealing the Noumenon attribute of crime, the author establishes the spirit and principle of criminal law which accords with the requirements of modern rule of law; second, through the empirical analysis of crime phenomenon in criminology, the author obtains a scientific understanding of the causes of crime, its occurrence and development law. The third is to insist on the normative analysis of crime research in the field of criminal law and to provide theoretical guidance and technical support for the objectivity of criminal justice.
