网络社会治安问题及对策研究

【摘要】： 二十一世纪是一个科技日新月异的时代，其中最引人注目的就是信息产业进入了高速发展时期。信息网络的普及逐渐在改变着人们的传统生产生活方式，还带来了社会其他各个方面的变革。与此同时也对社会秩序的稳定造成了巨大的冲击——人们的交往途径从现实走向虚拟空间，同时社会个体的人性弱点开始在网络中得到萌发与张扬，，其表现形式为不少人想通过网络来宣泄个人对社会的不满，利用网络来从事各种犯罪活动；青少年一代进入到网络社会中，并成为互联网的主体，青少年犯罪率迅速上升；一些不良社会影响通过网络媒体的快速传播并被青少年群体模仿甚至创造出更邪恶的形式，各种犯罪活动在网络的蔽护下显得更加隐蔽。在这样一个大的背景之下，网络社会的治安问题日显突出。基于网络的社会活动是当代人类社会生活的一个越来越重要的方面，维护网络社会的公共秩序的安全是当前公安部门的当务之急，因此采用怎样的治安管理措施来确保政治的安定团结和社会的正常运行尤为重要。网络社会不同与传统社会有其自身的独特一面，所以传统的治安体制在网络面前显得有些力不从心，还不足以完全控制整个信息化时代的社会局面，治安措施必须在原有的技术上大力创新。本文基于对网络社会高自由度、开放性、虚拟性等特征的描述，结合大量网络犯罪事实和案例的分析，提出犯罪手段更加隐蔽、犯罪手段高度技术化、犯罪主体青少年化是当前网络犯罪的主要特征；基于人类社会从工业社会向信息社会转型的社会历史背景，分析了网络犯罪问题凸现的社会文化原因、社会心理原因及法律制度缺失等方面的原因。欧洲，美国韩国等国家和地区在经济的支撑下早已经踏上了信息高速公路的进程，它们在信息化发展道路上遇到的困难的解决，为国内的网络发展中遇到的治安问题的解决起到很好的示范作用，在借鉴国外先进经验的基础上，结合我国的实际状况提出了加强青少年网络道德教育工作，引导公民健康的网络文化观念、提高警务人员的思想道德素养和提高现代化条件下办案能力、充分发挥群众的社会监督和举报作用等解决网络社会治安问题的对策。
[Abstract]:The 21 century is an era of rapid development of science and technology, in which the information industry has entered a period of rapid development. The popularization of information network is changing people's traditional way of production and life, and it also brings about the change of other aspects of society. At the same time, it also caused a huge impact on the stability of social order-people's way of communication from reality to virtual space, at the same time, the human weakness of social individuals began to germinate and spread in the network. Its manifestation is that many people want to vent their dissatisfaction with the society through the network, use the network to engage in various criminal activities, the youth generation into the network society, and become the main body of the Internet, the juvenile crime rate is rising rapidly; Some bad social influences spread quickly through the network media and were imitated or even created a more evil form by the youth group. All kinds of criminal activities appear to be more hidden under the protection of the network. Under such a big background, the network society's public order problem becomes more and more prominent. Network-based social activities are an increasingly important aspect of contemporary human social life. It is imperative for the public security departments to maintain the public order of the network society. Therefore, what kind of security management measures should be adopted to ensure political stability and social normal operation is particularly important. The difference between the network society and the traditional society has its own unique side, so the traditional public security system seems to be unable to do what it wants in front of the network, and it is not enough to completely control the social situation in the entire information age. Public security measures must be innovated in the original technology. Based on the description of the characteristics of network society, such as high degree of freedom, openness and fictiveness, combined with the analysis of a large number of network crime facts and cases, this paper puts forward that the criminal means are more subtle, and the criminal means are highly technical. The juvenile crime subject is the main feature of the current cybercrime, based on the social and historical background of the transition from the industrial society to the information society, the social and cultural reasons for the problem of cybercrime are analyzed. Social psychological reasons and the lack of legal system and other reasons. Europe, the United States and South Korea and other countries and regions have already embarked on the process of the information superhighway under the support of the economy. They have encountered difficulties in solving the difficulties encountered on the road of information development. It plays a good role in demonstrating the solution of the public security problems encountered in the development of the domestic network. On the basis of drawing lessons from the advanced experience of foreign countries and combining the actual situation of our country, this paper proposes to strengthen the work of network moral education for teenagers. The countermeasures to solve the problems of network social security are to guide citizens' healthy concept of network culture, to improve the ideological and moral accomplishment of police personnel and to improve the ability of handling cases under the modern conditions, and to give full play to the social supervision and reporting role of the masses.
