【摘要】： 随着被害人学的产生与发展,犯罪被害人问题逐渐引起社会各界的普遍重视,人们开始从被害人角度出发,来重新审视犯罪问题。强奸犯罪作为性犯罪中数量最多、性质最严重的犯罪之一,其社会危害性是巨大的。强奸罪被害人在强奸行为发生及进行过程中,并不是完全被动的,在某些情况下,是由于强奸罪被害人某些行为特征而引发被害的。因此,对强奸罪被害人进行研究,有利于减少强奸犯罪的发生,具有重要的理论意义和实践价值。本文在对于强奸罪被害人的概念、特征、分类进行分析的基础之上,探究强奸罪被害人的被害原因,并针对其致害原因制定相关的预防措施,同时,从法律以及实践层面加强对强奸罪被害人的保护,以期减少与遏制强奸被害的发生,从而达到预防、治理强奸犯罪的目的。
[Abstract]:With the emergence and development of victimology, the problem of victims of crime gradually attracted the attention of all walks of life. People began to re-examine the problem of crime from the perspective of victims. Rape is one of the most serious crimes in sexual crimes, and its social harmfulness is enormous. The victim of rape is not completely passive in the process of rape. In some cases, the victim of rape is killed because of some characteristics of his behavior. Therefore, the research on the victim of rape crime is helpful to reduce the occurrence of rape crime and has important theoretical significance and practical value. Based on the analysis of the concept, characteristics and classification of rape victims, this paper explores the causes of rape victims' victimization, and formulates relevant preventive measures against the causes of rape crime victims, at the same time, From the aspect of law and practice, we should strengthen the protection of the victims of rape in order to reduce and restrain the occurrence of rape victims, so as to achieve the purpose of preventing and controlling rape crimes.
