笔迹分析在司法实践中运用探究

【摘要】：笔迹是人们通过书写练习活动而形成的反映书写人书写技能、习惯以及性格、心理等的文字符号的形象系统,与书写人的人格具有一定的相关性,可以通过对笔迹的书写特征和规律的研究,分析书写者的性格、心理和行为方式等特点,这样的一种特殊心理分析技术就叫做笔迹分析。笔迹分析技术在国外的研究和应用比较广泛,在我国,研究的起步较晚,领域相对狭窄,应用的范围和程度也有待扩展和加强。 笔迹分析在司法实践中具有很大的实践意义,通过笔迹分析可以刻画犯罪人的心理性格和行为方式,为案件侦查提供线索,同时,在辨别笔迹真伪、预防犯罪、犯人改造等方面也可以发挥作用。目前,笔迹分析在国内的司法实践中已崭露头角,但是针对笔迹分析运用于司法实践的研究还相对滞后,西方在此方面的研究值得借鉴,但是由于东西方字迹的区别以及人格差异的存在,其研究结论的可参考程度有所降低。所以,本文拟从实证数据研究的角度,探讨笔迹与人格之间的关系,以及笔迹分析在司法实践中的运用方法和价值。 全文共有四个部分: 第一部分主要探讨了笔迹分析的概念内涵及研究价值。在结合笔迹的概念、理清笔迹学、笔迹鉴定、笔迹分析三个概念关系的基础上得出笔迹分析的概念内涵。根据笔迹特征对人格的表达性和笔迹特征的相对稳定的再现性或规律性,剖析笔迹分析理论的原理。简要介绍了笔迹分析目前在司法实践中运用的比较少的原因,以及笔迹分析在司法实践中的运用价值,得出本文研究的主题具有重要意义。 第二部分主要对国内外笔迹分析技术的研究和运用状况做了简要的综述。分别介绍了国外笔迹分析技术研究情况、研究结果以及实践运用情况,我国古代笔迹分析人格的思想渊源、近些年笔迹分析研究结果和实践运用情况。 第三部分主要是通过实证研究探讨笔迹与书写人性别、人格的关系。实验对60名在校学生的笔迹进行观察,选取一系列笔迹特征进行量化处理,然后运用T检验和spearman等统计分析方法,将其与这些被试者的艾森克人格测试分值进行相关性研究,从而发现笔迹与性别、笔迹与人格之间的关系。结论包括三部分,分别是笔迹特征的性别差异、男性笔迹特征与人格关系、女性笔迹特征与人格关系。 第四部分主要阐述了司法实践中笔迹分析的方法与运用。笔迹分析方法的阐述按照其流程主要包括三个方面,首先是介绍笔迹分析材料的来源与要求,其次说明笔迹分析的步骤与方法,再次是笔迹分析意见的形成。笔迹分析在司法实践中运用的内容有:判断和刻画行为人性别和人格、结合笔迹鉴定发现伪装、犯罪预防和犯人改造,在阐述运用笔迹分析技术刻画行为人人格的部分,还选取了50位狱内犯人笔迹与普通在校大学生笔迹做了特征数据比对,得出了盗窃犯罪人和暴力犯罪人笔迹特征特点。最后,对笔迹分析技术相对局限性做了分析,提出在司法实践中运用时应给予重视。
[Abstract]:The handwriting is an image system that reflects the writing skills , habits and characters , psychology and so on of the writer through writing exercises . It has a certain correlation with the author ' s personality . This kind of special psychological analysis technique is called handwriting analysis . The research and application of handwriting analysis technology are widely used in foreign countries . In China , the research starts late , the field is relatively narrow , and the scope and extent of application are also to be expanded and strengthened .
The handwriting analysis is of great practical significance in judicial practice , and it can be used as a clue to the investigation of cases . However , the study of handwriting analysis in the practice of judicial practice has become more and more important . At present , the study of handwriting analysis in the practice of judicial practice has lagged behind . However , this paper intends to explore the relationship between handwriting and personality , as well as the application method and value of handwriting analysis in judicial practice due to the differences of handwriting analysis and personality differences .
The full text has four parts :
The first part mainly discusses the concept connotation and the research value of the handwriting analysis . Based on the concept of handwriting , the author draws the concept connotation of handwriting analysis on the basis of three concepts of handwriting analysis , handwriting identification and handwriting analysis . The paper briefly introduces the reasons why the handwriting analysis is used in judicial practice and the application value of handwriting analysis in judicial practice , and concludes that the subject of this paper is of great significance .
The second part gives a brief review of the research and application of handwriting analysis technology at home and abroad .
The third part mainly discusses the relationship between handwriting and writing human ' s gender and personality through empirical research .
The fourth part mainly expounds the method and application of handwriting analysis in judicial practice .
