高校职务犯罪控制对策研究

【摘要】： 反腐倡廉是一项重大的政治任务。近年来,高校贪污、受贿、挪用公款等职务犯罪案件呈呈现上升、多发趋势,已成为高校发展的不和谐音符和严重的社会公害,也是国家、各级领导干部和普通百姓最为关注的社会问题之一。高校发生的违纪违法案件,不仅给国家和人民的财产带来极大损失,而且给学校各项事业的发展带来很大损害,阻碍了学校改革发展的进程,涣散了教职员工队伍,败坏了高等学校的社会声誉,破坏了对未成年人道德建设和大学生思想政治教育的环境,也给高等教育发展的大好局面造成负面影响。因此,控制高校职务犯罪已成为我国高等教育事业发展的迫切要求,成为我们刻不容缓的研究课题。 本文分析了我国社会转型期高校在图书教材、设备采购、基建工程、招生录取等方面出现的贪污贿赂、渎职失职、滥用职权等违法犯罪问题及其特点,指出了控制高校职务犯罪势在必行。在此背景下,引入国内外关于职务犯罪原因的主要理论,并以此理论为基础,总结了腐败的一般规律和现阶段的历史特殊性,着重剖析了我国社会转型期高校职务犯罪的主要原因,并从高校内部原因、社会环境原因、犯罪主体原因等三个方面展开进行了系统阐述。 最后,本文从理论和实践的结合上,紧贴发展着的高校反腐倡廉工作实际,以解放思想和改革创新的精神,试图从减少腐败机会,切断腐败过程,控制腐败空间,加大腐败成本,强化腐败风险,抑制腐败动机,阻止腐败目的,消除腐败心理等方面综合考虑,建立健全多措并重的高校职务犯罪控制体系,使腐败分子不敢腐败、不想腐败、不能腐败、不会腐败。
[Abstract]:Anti corruption and clean government are a major political task. In recent years, crimes of corruption, bribery and misappropriation of public funds in Colleges and universities have shown a rising and multiple trend, which have become inharmonious notes and serious social hazards in the development of colleges and universities. It is also one of the social problems that the state, leading cadres at all levels and the common people are most concerned about. The case of disciplinary law not only brought great losses to the property of the state and the people, but also brought great damage to the development of various schools, hindered the process of the reform and development of the school, laxed the staff of the faculty and staff, destroyed the social reputation of the higher schools, and destroyed the ring of the moral and ideological and political education of the uneducated people and the college students. It has also had a negative impact on the development of higher education. Therefore, it has become an urgent requirement for the development of higher education in our country to control the duty crime in Colleges and universities, and it has become a very urgent subject for us to study.
This paper analyzes the problems and characteristics of corruption and bribery, dereliction of duty and abuse of power in the period of social transformation in the period of social transition in China, and points out that it is imperative to control the crime in Colleges and universities. In this context, the main reason for the reasons for the duty crime is introduced. On the basis of this theory, the general law of corruption and the historical particularity of the present stage are summarized, and the main reasons for the duty crime of colleges and universities in the period of social transformation in our country are analyzed, and the three aspects of the internal causes, social environment reasons and the main cause of the crime are systematically expounded.
Finally, on the basis of the combination of theory and practice, this article is closely related to the practice of anti-corruption and innovation in Colleges and universities, in order to emancipate the mind and innovate the spirit of innovation, try to reduce the corruption opportunity, cut the corruption process, control the corruption space, increase the cost of corruption, strengthen the risk of corruption, restrain the motive of corruption, prevent the purpose of corruption and eliminate the psychology of corruption and so on. Considering comprehensively, we should establish and improve the control system of job-related crimes in Colleges and universities, so that corrupt elements dare not corrupt, do not want to corrupt, can not corrupt, will not corrupt.
