论我国未成年犯的社区矫正制度

【摘要】：未成年人的身心处于发展过程,可塑性较强,对于未成年的教育和矫正成为未成年人保护工作中重要一项,而修改后的刑诉法在提升未成年人保护工作水平方面的努力有目共睹,与此同时,进一步完善未成年相关立法的呼声也再次响起。社区矫正在我国作为新生事物,是对传统执行方式的一种创新与突破。而新制度构建的快速性使得社区矫正工作实践中出现了衔接隐患。因此,社区矫正制度相关立法中也应共同承担保护未成年的责任,针对未成年社区矫正工作实践中出现的衔接隐患应予以重点关注。笔者通过对常德市各级法院、各司法局进行实地调研、分发调查问卷及对部分检察院社区矫正相关工作人员、中小学教研员分发调查问卷的方式发现了常德市未成年社区矫正制度执行存在的问题并找出了三个环节的特点。针对问题,结合法院审判工作及社区矫正工作,在借鉴国内先进经验、国外先进制度的基础上,笔者从工作理念及方法、立法、具体制度及国家监管制度缺失四个方面分析了原因,并由此从改革司法理念、完善立法、相关部门进一步完善相关配套制度三个方面提出了完善未成年社区矫正制度的对策。
[Abstract]:The body and mind of minors are in the process of development, and the plasticity is relatively strong. The education and correction of minors has become an important item in the protection of minors. The revised Criminal procedure Law in the work of improving the level of protection of minors is obvious to all, at the same time, the voice to further improve the relevant legislation on minors is heard again. Community correction as a new thing in our country is an innovation and breakthrough to the traditional execution way. And the rapid construction of the new system makes the practice of community correction a hidden danger of convergence. Therefore, in the relevant legislation of community correction system, we should share the responsibility of protecting minors, and focus on the hidden dangers of convergence in the practice of minor community correction. Through the field investigation of the courts and judicial bureaus at all levels in Changde City, the author distributes the questionnaire and the relevant staff of some procuratorates on community correction. In the way of distributing the questionnaire, the teachers and researchers of primary and secondary schools find out the problems existing in the implementation of the minor community correction system in Changde City and find out the characteristics of three links. Aiming at the problems, combining the court trial work and the community correction work, on the basis of drawing lessons from the domestic advanced experience and foreign advanced system, the author from the work idea and method, legislation, This paper analyzes the reasons from four aspects of the lack of concrete system and national supervision system, and puts forward the countermeasures of perfecting the minor community correction system from three aspects: reforming the judicial idea, perfecting the legislation, and further perfecting the relevant supporting system.
