论犯罪心理测试与刑事诉讼

【摘要】：本文介绍了犯罪心理测试技术的基本概念和基本原理,以及国内外在刑事诉讼领域应用犯罪心理测试技术的概况,指出犯罪心理测试技术在综合心理学、生理学和现代电子学、计算机信息技术、传感器技术等多种应用科学技术设计而成,它建立在一定的科学原理之上, 因而也大量的刑事诉讼实务中显示出高度的准确性,对案件事实的侦查和证明发挥出明显作用。但是与犯罪心理测试技术在刑事诉讼领域的大量应用极不适应的是我国法律对此几乎未作任何规定。参考国外相关的刑事司法理论和立法,根据我国刑事诉讼证据理论对犯罪心理测试结论进行考察,犯罪心理测试结论具备了证据的基本属性,可以对案件事实起到一定的间接证明的作用。针对犯罪心理测试技术在我国刑事诉讼领域应用存在的问题,本文对犯罪心理测试程序的启动、测试对象、测试人员的资格、测试程序以及测试结论的审查和使用等多方面的问题进行了探讨。
[Abstract]:This paper introduces the basic concept and principle of criminal psychology testing technology, and the general situation of applying criminal psychology test technology in the field of criminal procedure, and points out that criminal psychology testing technology is in comprehensive psychology. Physiology and modern electronics, computer information technology, sensor technology and other applied science and technology are designed. They are based on certain scientific principles, and thus show a high degree of accuracy in the practice of a large number of criminal proceedings. The investigation and proof of the facts of the case play an obvious role. However, the criminal psychological testing technology in the field of criminal proceedings is extremely unsuitable for the law of our country almost has not made any provisions. Referring to the relevant criminal justice theory and legislation abroad, and according to the evidence theory of criminal procedure in our country, the conclusion of criminal psychological test is investigated. The conclusion of criminal psychological test has the basic attribute of evidence. It can play an indirect role in proving the facts of the case. In view of the problems existing in the application of the criminal psychology test technology in the field of criminal procedure in our country, this paper starts the criminal psychology test procedure, the object of the test, the qualification of the tester, The test procedure and the examination and use of test conclusions are discussed.
