公共物品理论视野下的社区矫正——一种法经济学的分析

【摘要】：公共物品理论认为,公共物品提供过程中存在市场失灵和政府失灵的情况。因此,完全由政府提供公共安全服务的监禁矫正方式存在诸多弊端。例如,政府在罪犯矫正方面的投入产出比较低,可能带来预算扩张、机构膨胀、供给低效、再扩张预算的恶性循环,容易滋生官僚作风与腐败行为,等等。政府与第三部门同为主体提供的社区矫正能有效地弥补监禁矫正的缺陷,具有降低矫正成本、提高矫正工作绩效及政府的投入产出比等多方面的优势。
[Abstract]:According to the theory of public goods, there is market failure and government failure in the process of public goods supply. Therefore, there are many drawbacks in the correctional mode of imprisonment, which is provided by the government. For example, the relatively low government input and output in criminal correction may lead to budget expansion, institutional expansion, inefficient supply, a vicious circle of budget expansion, easy breeding of bureaucracy and corruption, and so on. The community correction provided by the government and the third sector can effectively remedy the defects of the correction of imprisonment, which has the advantages of reducing the cost of correction, improving the performance of corrective work and the ratio of input and output of the government.
