论防治职务犯罪的制度建设与完善

【摘要】： 建立和完善防治职务犯罪制度在当前我国社会转型时期显得特别重要。防治职务犯罪制度包括权力配置制度、权力运行制度和权力监督制度。权力配置制度规范国有单位科学、合理、明确地配置权力。构建该制度旨在从权力的配置方面制约权力，减少权力腐败的机会，增加公职人员实施职务犯罪的难度。权力运行制度规范国家公职人员公正地行使权力。完善该制度旨在从权力的运行方面制约权力，为公职人员行使权力设定重重规范，使公职人员无法或难以实施职务犯罪，并以严密的责任制度威慑公职人员。该制度包括权力运行规范、公职人员行为规范和公职人员职务违法犯罪行为责任制度。其中，权力运行规范制约公职人员行使权力这一环节，公职人员行为规范则还制约公职人员的其他影响权力正当运行的行为和事项。权力监督制度保障和规范权力监督主体对国有单位和国家公职人员执行权力配置制度和权力制约制度的情况进行监督。健全该制度要求一方面从监督主体地位独立、监督权赋予等方面保障监督主体行使监督职权，另一方面又要对各监督主体行使监督权进行约束，，使其相互协调形成一个有序高效的监督系统，并依法公正、积极地履行监督职责。
[Abstract]:It is very important to establish and perfect the system of preventing and controlling duty crime in the period of social transformation. The prevention and cure duty crime system includes the power disposition system, the power movement system and the power supervision system. The power allocation system standardizes the state-owned units scientifically, reasonably, clearly allocates the power. The purpose of this system is to restrict the power from the aspect of power allocation, reduce the opportunity of power corruption, and increase the difficulty for public officials to carry out duty crime. The system of power operation regulates the fair exercise of power by state public officials. The purpose of this system is to restrict the power from the operation of the power, to set a lot of norms for the public official to exercise the power, to make the public official unable or difficult to carry out the crime of duty, and to deter the public official with the strict responsibility system. This system includes power operation norm, public official behavior norm and public official duty illegal crime responsibility system. Among them, the norms of the operation of power restrict the exercise of power of public officials, and the norms of conduct of public officials also restrict other actions and matters that affect the proper operation of power of public officials. The power supervision system ensures and standardizes the power supervision subject to supervise the execution of the power allocation system and the power restriction system by the state-owned units and the state public officials. Perfecting the system requires, on the one hand, to guarantee the exercise of supervisory authority by the subject of supervision from the aspects of independence of the supervisory subject and endowing of the supervisory power, on the other hand, to restrict the exercise of the supervisory power of the supervisory subject. Make it coordinate with each other to form an orderly and efficient supervision system, and carry out supervision duties according to law and justice.
