法治视野下我国户籍制度改革研究

【摘要】： 户籍制度无论在任何历史时期都是一项重要的社会制度。中国古代的户籍制度是统治阶层控制社会的主要工具,它担负着社会控制和征发赋税徭役的功能。中国古代户籍制度的改革体现了由血缘身份到职业身份的转化;近代,传统的户籍制度随着西风东渐的冲击也翻开了崭新的一页,逐步由家国一体的管理模式向保障个人权利的管理模式转化;在现代,中国户籍制度也同样与劳动、教育、就业等人民切身利益息息相关,而户籍制度也发生了从军事管制到社会治安再到服务于民的制度及理念两个层面上的变化。本文通过对中国户籍制度改革历史进程的考察,阐述了中国户籍制度从士族赋役制向职业身份赋役制、从职业身份赋役制到保甲制、从保甲制到治安户籍制再到新中国保障人民权益的户籍制度这一系列从身份到契约的演进历程。试图在法治视野下审视古今户籍制度改革和发展的特点、户籍制度改革的影响因素以及户籍制度改革的历史局限性,为当今我国户籍制度改革提供有益的借鉴。
[Abstract]:Household registration system is an important social system in any historical period. The household registration system in ancient China is the main tool for the ruling class to control the society. It bears the functions of social control and taxation and corvee. The reform of the household registration system in ancient China reflected the transformation from consanguinity to professional identity. In modern times, the traditional household registration system has turned a new page with the impact of the western-eastward development, and gradually transformed from the management mode of integrating the family and the country to the management mode of protecting the individual rights. In modern China, the household registration system is also closely related to the vital interests of the people, such as labor, education, employment and so on. Based on the investigation of the historical process of the reform of the household registration system in China, this paper expounds that the household registration system in China has changed from the system of civil service to the system of duty of professional status, from the system of duty of occupation to the system of protection. From the system of security to the system of public security and then to the system of household registration to protect the rights and interests of the people in New China, this series of evolution from identity to contract. This paper attempts to examine the characteristics of the reform and development of the household registration system from the perspective of the rule of law, the influencing factors of the reform of the household registration system and the historical limitations of the reform of the household registration system, which provides a useful reference for the reform of the household registration system in our country today.
