警察讯问话语批评分析

【摘要】：本研究属于法学和语言学交叉领域法律语言学的一个分支,是警察执法口语语言的动态、过程研究。本研究对警察讯问话语中权力关系进行了批评分析,目的是为展现警察讯问话语中的权力不对称现象,并提出若想达到警察讯问的机构目的,即在保障人权的基础上有效获得犯罪嫌疑人真实自愿地供述,警察就需要调整讯问话语中的不平衡权力关系,向着互动双方参与的“会话”方向转变,实现由“讯问(Interrogation)”向“询问(Interview)”的转变。 第一章导论综述法律语言学、警察讯问话语等相关研究,简要介绍了本研究的目的、内容和意义。 第二章是有关语言理论和研究方法的介绍。本章对权力的概念进行了解析,提出了适合本研究的权力操作概念,构建了以权力分析为问题中心的,综合批评话语分析工具的研究框架。本研究的研究方法和语料情况也在本章做了说明。 第三章分析警察讯问话语的机构特征。本章着重考察了机构话语研究的历史和概念,归纳了警察讯问话语的机构话语特征,分析了机构话语语境下的权力关系问题。 第四、五、六章运用会话分析方法对警察讯问话语的形式进行了描述。第四章主要对警察讯问话语进行了结构分析。借助参与角色理论,提出了警察讯问话语的理想参与框架。 第五章基于语料数据专门分析了警察讯问中的问话行为,展现了我国警察讯问的现状以及讯问中警察是如何利用问话来行使权力的。 第六章对警察所掌握的语言互动控制资源进行分析,进一步揭示讯问中的警察是如何使用这些语言形式控制和支配犯罪嫌疑人,实现自己交际目的的。 第七章考察警察讯问话语中的警察故事版本与犯罪嫌疑人故事版本的协商和斗争。通过展示在此过程中警察讯问者所采取的种种话语控制手段来说明警察讯问者在犯罪事实构建过程中表现出的强势话语权力。 第八章则对犯罪嫌疑人的答话行为进行了分析。在最低程度上遵守合作原则的基础上,犯罪嫌疑人会采用某些抵制策略来防御警察讯问者控制性问话。但这种权力抵制大都是被动的、防御性的,不能改变犯罪嫌疑人的弱势地位。 第九章总结全文,指出警察讯问话语中权力不对称会影响到机构目的的实现,由此提出“会话式”警察讯问模式。笔者还阐述了本研究对警察讯问实践的启示,指出了警察讯问语言使用中的不规范之处并研拟了中国警察讯问语言规范建议稿。最后指出了本研究的特色、局限和今后努力方向。
[Abstract]:This research is a branch of forensic linguistics in the intersection of law and linguistics, which is the dynamic and process study of the spoken language of police law enforcement. The purpose of this study is to show the asymmetry of power in police interrogation discourse and to achieve the institutional purpose of police interrogation. That is to say, on the basis of the protection of human rights, the police need to adjust the unbalanced power relationship in interrogation discourse and change to the direction of "conversation" in which the interactive two sides participate in effectively obtaining the true and voluntary confession of the criminal suspect. The transformation from "interrogating (Interrogation)" to "questioning (Interview)" is realized. The first chapter is an introduction to forensic linguistics, police interrogation discourse and other relevant studies, briefly introduced the purpose, content and significance of this study. The second chapter is about the language theory and the research method. This chapter analyzes the concept of power, puts forward the concept of power operation suitable for this study, and constructs a comprehensive framework of critical discourse analysis tools with power analysis as the focus. The research methods and corpus of this study are also explained in this chapter. The third chapter analyzes the institutional characteristics of police interrogation discourse. This chapter focuses on the history and concept of institutional discourse studies, summarizes the institutional discourse characteristics of police interrogation discourse, and analyzes the power relationship in the context of institutional discourse. The fourth, fifth and sixth chapters describe the form of police interrogation discourse by conversational analysis. The fourth chapter mainly analyzes the structure of police interrogation discourse. With the help of the theory of participative role, the ideal framework of police interrogation discourse is put forward. The fifth chapter analyzes the questioning behavior in police interrogation based on the data of corpus, and shows the current situation of police interrogation in China and how police use interrogations to exercise their power. The sixth chapter analyzes the language interactive control resources held by the police and further reveals how the police use these language forms to control and dominate the criminal suspects to achieve their communicative purposes. Chapter seven examines the negotiation and struggle between the police story version and the suspect story version in the police interrogation discourse. By demonstrating the various discourse control measures adopted by the police interrogators in this process, this paper illustrates the powerful discourse power shown by the police interrogators in the process of constructing the criminal facts. The eighth chapter analyzes the behavior of criminal suspects. On the basis of following the principle of cooperation to the minimum degree, the suspect will adopt some resistance tactics to defend the police interrogator from controlling questioning. However, this kind of power resistance is mostly passive, defensive and cannot change the weak position of the suspect. Chapter nine summarizes the full text and points out that the asymmetry of power in the police interrogation discourse will affect the realization of the purpose of the organization, and thus puts forward the "conversational" police interrogation mode. The author also expounds the enlightenment of this study to the practice of police interrogation, points out the irregularities in the use of police interrogation language, and draws up the suggestions on the language norms of police interrogation in China. Finally, the characteristics, limitations and future direction of this study are pointed out.
