劳动教养执行程序改革研究

【摘要】: 劳动教养制度自1957年创立至今,通过五十余年的探索和实践,已经形成了公安机关办案呈报、劳动教养委员会审查决定、劳动教养机关负责执行,人民检察院实行监督的独具特色的程序模式。 执行程序是劳动教养制度的最后一道程序。五十多年来,劳动教养制度在预防犯罪、维护治安、稳定社会方面发挥了重要的作用。这些作用,都是通过执行程序得以实现的。 尽管如此,劳动教养执行程序却在收容、变更、解教等环节以及管理、教育、生产等手段的运用过程中,仍存在诸多弊端,这些弊端形成的原因是多方面的,不仅有制度设计上的,有实践操作中违规的,还有文化层面的。 为此,理论界和司法实践部门都在进行有益的反思。本文认为,劳动教养执行程序的改革势在必行,首先在立法理念上,需要从国家优位主义向人权保护主义转变,坚持法治理念、以人为本的理念变革;其次在方法革新方面,应打破原来类似监狱的,高度封闭、强制劳动、单边教育的习惯程式,代之以向社会开放、向劳教人员家庭延伸、向劳教人员个人渗透的多样化的管理模式并引入科学的矫治方法;还要在制度的设计、体系的统一、内容的规范、监督和救济机制健全等方面进行立法完善,以更好地发挥劳动教养制度的作用,实现劳动教养制度的宗旨。 全文分四章进行论述:第一章主要从内涵和外延上界定劳动教养执行程序的概念;第二章论述劳动教养执行程序的立法现状、实践现状、现行劳动教养执行程序存在的弊端及原因分析;第三章从程序正义和实体正义的实现、保障劳教人员的人权、社会稳定和法律秩序的建立、消除国际不良影响等四个角度阐述劳动教养执行程序改革的价值;第四章提出劳动教养执行程序理念变革、方法革新、立法完善等三大改革对策。
[Abstract]:Since its inception in 1957, through more than 50 years of exploration and practice, the system of reeducation through labour has formed a public security organ to report cases, examine and decide by the reeducation through labour committee, and the reeducation through labour organ is responsible for its implementation. The people's procuratorate carries out the unique procedure mode of supervision. The execution procedure is the last procedure of the system of reeducation through labour. For more than 50 years, the reeducation-through-labour system has played an important role in crime prevention, public security and social stability. These functions are achieved through the execution of procedures. In spite of this, there are still many drawbacks in the implementation of the procedure of re-education through labour in the process of admission, change, interpretation of education and the use of management, education, production and other means. The reasons for these malpractices are various. There are not only institutional design, practice in violation of the operation, but also the cultural level. For this reason, the theory circle and the judicial practice department are all carrying on the beneficial reflection. This paper argues that the reform of the implementation procedure of re-education through labour is imperative. Firstly, it is necessary to change from national superiority to human rights protectionism, adhere to the concept of rule of law, and change the concept of people-oriented. Secondly, with regard to the reform of methods, we should break the customary pattern of highly closed, compulsory labour and unilateral education similar to prisons, and replace them with opening up to society and extending to families of reeducation through labour. (a) infiltrating diversified management models into individual reeducation through labour personnel and introducing scientific corrective methods; It is necessary to perfect the legislation in the aspects of system design, system unification, content standardization, supervision and relief mechanism, so as to give full play to the function of reeducation-through-labor system and realize the purpose of reeducation-through-labor system. The thesis is divided into four chapters: the first chapter defines the concept of reeducation-through-labor execution procedure from the connotation and extension. The second chapter discusses the legislative status quo of the enforcement procedure of re-education through labor, the practice status quo, the malpractice of the present procedure of re-education through labor and the analysis of the reasons. The third chapter expounds the value of the reform of the procedure of reeducation through labor from four angles: the realization of procedural justice and substantive justice, the protection of the human rights of reeducation through labour personnel, the establishment of social stability and the establishment of legal order, and the elimination of the negative international influence. The fourth chapter puts forward three reform countermeasures, such as the reform of the concept of the procedure of reeducation through labor, the innovation of the method and the perfection of the legislation.
