未成年人社区矫正立法建议

【摘要】：社区矫正已经并将进一步成为我国未成年人矫正制度的主体。在社区矫正立法过程中,应当充分考虑未成年人的特殊性,体现对未成年人的特殊优先保护。综合考虑,建议采取专章立法模式,在《社区矫正法》中设置未成年人专章。这不仅是实践的需要,也是上位法的要求,还是完善我国未成年人法律体系、未成年人司法制度的重要组成部分。《社区矫正法》设置未成年人专章不仅具有必要性并且具备可行性。
[Abstract]:Community correction has become and will further become the main body of the minor correction system in our country. In the process of community correction legislation, the particularity of the minor should be fully considered, and the special priority protection for the minor should be reflected. It is suggested to adopt a special legislation model and set up a special chapter on minors in the Community Correction Law. This is not only the need of practice, but also the requirement of upper law, or the perfection of the legal system of minors in our country. The Community Correction Law is not only necessary but also feasible.
