当代中国地方人大代表的角色扮演与代表行为研究

【摘要】：我国地方各级人民代表大会作用发挥的前提和基础是地方各级人大代表。当前由于各种客观主观的原因,我国地方人大代表的实际代表行为离法律的规定与人民的期望还有一定的差距,这在一定程度上不仅影响了地方各级人民代表大会发挥功能而且也使我国人民代表大会制度作用的发挥受到限制。面对当前基层人大代表这一现状,若忽视地方人大代表的来源、地方人大代表的角色扮演、代表行为方式与行为取向、以及代表素质与参政议政能力,必将影响到地方人民代表大会的健康运行。因此,十分有必要系统地分析地方人大代表代表性行为的类型及其所扮演的角色。基于此,考虑到地方人大代表在我国人大代表制度中的重要作用,本文将从角色承担及代表性行为类型的视角出发,就地方人大代表展开研究。本文主要涵盖以下四个方面：第一部分,系统梳理代表理论。代表理论是随着西方代议民主发展演变的历史过程中逐步发展起来的。代表和选民关系是代表理论的核心问题,围绕这一核心问题随即产生一系列基本问题：谁是代表、代表什么、如何代表、如何才是好的代表等等。然而,不同时代、不同流派的理论家对这些问题的回答,有着不同的见解,这也同时反映了不同的代表理念。在当代中国认真和正面地对待代表理论,是理解我国人民代表大会制度的规范与各级人大代表行为实践的需要。第二部分,阐述地方人大代表的角色扮演与地方人大代表行为的类型。对人大代表角色扮演认知以及分类进行研究,通过观察近年来出现的案例,发现地方人大代表角色的扮演、地方人大代表行为倾向、地方人大代表履职行为方式都呈现出不同的类型,在地方人大代表的不同行为取向中也体现了地方人大代表的代表性。第三部分,描述当前地方人大代表的角色冲突与行为分化的现象,并对代表出现的这种代表性行为偏差进行了较为系统的原因分析。基层人大代表作为我国国家、政府与民众之间的桥梁,其面临着两种不同的角色期望,也就会有角色冲突的可能性。地方代表兼职制度在一定程度保证民主的同时,给了代表双重身份加之代表自身素质的原因加剧了代表角色冲突。同时,地方代表来自不同民族、集体、行业,他们不仅有共同的利益还有各自代表的特殊利益,这使得代表在行为和表决时作出利己的决定。地方利益主体的多元化、多层次性的客观存在以及对人大代表监督的乏力不利于地方人大代表行为分化的防范。第四部分,结合代表理论的基本理念以及我国地方人大代表行为偏差的现实原因,提出提升地方人大代表代表性的方向性建议。通过化解地方人大代表的身份冲突,不断地提高代表的任职资格,把对代表的选择、培训纳入到机制当中,逐步完善对地方人大代表行为的约束机制,使地方人大代表的素质能有效提高,代表的行为朝着有利于国家、地方政府与选民利益的方向发展。总之,作为国家权力机关的组成人员,地方人大代表在政治参与中的角色扮演以及代表履职中所体现的代表行为关系到地方人大代表功能的发挥。因此,对于政治实践中地方代表出现的角色冲突和代表行为分化现象,在给予足够重视的同时,还应从地方人大代表代表性行为偏差的原因入手,通过转变角色观念、化解身份冲突、完善代表任职及行为保障机制,来矫正地方人大代表的行为偏差。充分发挥地方人大代表在人大制度中的代表性作用,实现地方人民代表大会的健康运行。
