西安环境影响评价公众参与问题研究

【摘要】：公众参与环境影响评价已经逐步成为当前地方政府为了解决环境污染所引发环境冲突问题所采取的主要方式之一。尤其是近几年,随着绿色经济的发展需求和民主政治被社会公众广泛认同,这进一步加快了公众参与环境问题在我国的发展速度。同时,公众的权利意识和利益意识不断增强,维权行为不断增加,公众参与的形式也不断多样化等多种有益因素影响,也使得我国在环境保护方面愈发显得民主与科学。也正是基于如此活跃的环保大背景下,本文以环境可持续发展理论、环境公共信托理论、公民参与等相关理论为基础,运用SPSS数据分析法和问卷调查法等,以采集到的西安市公众参与数据为例,对现阶段西安市环境影响评价公众参与问题现状进行相关性研究。首先是对当前西安市环境影响评价方面公众参与问题进行相关研究,主要包括:对西安市环境影响评价公众参与方面的相关制度与内容进行介绍,对现状调查进行分析。然后是通过分析发现西安市环境影响评价中的公众参与活动主要是受信息公开程度、政府政策水平、企业环境保护意识、公众受教育程度、公众环境保护意识等多影响。其次是对西安市环境影响评价公众参与存在的诸如:相关信息公开程度不高、公众参与缺乏有效性、公众参与范围较窄、公众缺乏有效监督手段、参与主体的环保意识薄弱等问题进行分析。接下来是介绍国外环境保护发达国家的公众参与环境影响评价发展经验借鉴。主要通过介绍美、日两国公众参与环境影响评价的范畴、方法和相关法律,结合我国当前需求进行相关联经验总结。最后是提升西安市环境影响评价公众参与的路径分析。针对西安市公众参与环境影响评价存在的五个问题,拟通过构建开放型的信息交流方式、程序化公众参与环境影响形式、合理确定公众参与范围、强化公众监督措施、加强对社会公众的环保意识教育等方法来改善当前参与现状。
[Abstract]:Public participation in environmental impact assessment has gradually become one of the main methods adopted by local governments to solve environmental conflicts caused by environmental pollution, especially in recent years. With the development needs of green economy and democratic politics widely recognized by the public, this has further accelerated the development of public participation in environmental issues in China. At the same time, the awareness of rights and interests of the public has been constantly strengthened. The increasing number of human rights actions and the variety of forms of public participation have made our country more democratic and scientific in terms of environmental protection. It is precisely against such an active background that environmental protection is taking place. Based on environmental sustainable development theory, environmental public trust theory and citizen participation theory, this paper applies SPSS data analysis method and questionnaire method, taking the collected public participation data in Xi'an as an example. The current situation of public participation in environmental impact assessment in Xi'an is studied. First of all, the public participation in environmental impact assessment in Xi'an is studied. It mainly includes: introducing the relevant system and content of public participation in environmental impact assessment in Xi'an, Then, through the analysis, it is found that the public participation in environmental impact assessment in Xi'an is mainly affected by the degree of information disclosure, the level of government policies, the awareness of environmental protection of enterprises, the degree of public education, Secondly, the public participation in Xi'an environmental impact assessment is not high, the public participation is not effective, the scope of public participation is narrow, and the public lacks effective means of supervision. The main body involved in the weak awareness of environmental protection and other issues are analyzed. The next part is to introduce the public participation in environmental impact assessment development experience of developed countries in foreign countries. Mainly through the introduction of the United States, The scope, methods and relevant laws of public participation in environmental impact assessment in Japan and Japan, Combining with the current needs of our country, this paper summarizes the relevant experience. Finally, it analyzes the path to enhance the public participation in environmental impact assessment in Xi'an. In view of the five problems existing in the public participation in environmental impact assessment in Xi'an, This paper intends to improve the current situation of participation by constructing an open mode of information exchange, procedural public participation in the form of environmental impact, reasonable determination of the scope of public participation, strengthening public supervision measures, and strengthening the public awareness of environmental protection education.
