国际非法移民治理的困境与出路

【摘要】：非法移民是一个国际现实问题,又是一个极富争议性的问题。国际非法移民治理是一个长期复杂的综合性工程,面临主权与人权的矛盾、法律原则与人道主义的矛盾、不同行为主体利益诉求之间的矛盾等诸多困境。正确认知非法移民问题的实质,科学判断非法移民的动因与性质,完善非法移民多层治理结构,充分发挥国家治理、区域治理与国际治理的互补性以实现全球均衡与可持续发展,是破解国际非法移民难题的必要途径。只有着眼于长远与根本,消除人类社会发展的不平衡现象,尤其是经济发展的失衡,加强国际体系的公正合理性,才能真正实现人的全面、自主、有尊严的发展。
[Abstract]:Illegal immigration is not only an international reality problem, but also a controversial issue.The management of international illegal immigrants is a long-term complex comprehensive project, which faces many difficulties, such as the contradiction between sovereignty and human rights, the contradiction between legal principles and humanitarianism, the contradiction between the interests of different actors and so on.Correctly recognizing the essence of the problem of illegal immigration, scientifically judging the motivation and nature of illegal immigrants, perfecting the multi-layer governance structure of illegal immigrants, and giving full play to national governance,The complementarity between regional governance and international governance to achieve global balance and sustainable development is a necessary way to solve the problem of international illegal migration.Only if we focus on the long-term and fundamental, eliminate the imbalance of human social development, especially the imbalance of economic development, and strengthen the justice and rationality of the international system, can we truly realize the all-round, autonomous and dignified development of human beings.
