大学生参与未成年人社会调查的探究

【摘要】：由社会力量担任少年刑事司法社会调查的实施主体是我国少年刑事司法社会调查制度实施主体改革的鲜明特色之一。大学生具有专业文化知识和正确的人生价值观,利用学生共青团平台、志愿者协会组织、社会工作组织,以志愿者、社工、准法律人身份参与到未成年人社会调查工作中,体现“教育、感化、挽救”的司法保护精神,协助司法机关对涉案未成年人在侦查阶段、审前阶段、矫正阶段、回归阶段等发挥“同伴教育”作用,促进社会调查工作专业化、规范化,为社会调查报告详实和客观提供了技术保障,是推动社会调查员制度建立和发展的有效路径。本篇文章分为五部分,第一部分介绍本人选题的背景,研究内容、目的和意义,并分析国内外研究的现状。第二部分概述我国未成年人社会调查的含义及其功能,介绍我国社会调查主体成分以及现状,以及分析大学生参与未成年人社会调查的可行性。第三部分介绍我国各地区大学生参与未成年人社会调查的探索,并列出大学生参与未成年人社会调查的各种优势。第四部分就是根据国内外大学生参与未成年人社会调查的比较,总结大学生参与未成年人社会调查过程中容易产生的四点问题。最后一部分就是提出可以解决上述四个问题的四个建议,以完善大学生参与未成年人社会调查的工作。
[Abstract]:It is one of the distinct characteristics of the reform of the social investigation system of juvenile criminal justice in our country that the social investigation of juvenile criminal justice should be carried out by social forces. College students with professional cultural knowledge and correct values of life, using the platform of the Communist Youth League of students, volunteer association organizations, social work organizations, as volunteers, social workers, quasi-legal people to participate in the social investigation of minors, To embody the spirit of judicial protection of "education, probation and rescue", to assist the judicial organs in giving play to the role of "peer education" in the investigation, pre-trial, correction and return stages of minors involved in the case, and to promote the specialization of social investigation work. Standardization provides technical guarantee for detailed and objective social investigation report and is an effective way to promote the establishment and development of social investigator system. This article is divided into five parts. The first part introduces the background, research content, purpose and significance, and analyzes the current situation of domestic and foreign research. The second part summarizes the meaning and function of the social investigation of minors in our country, introduces the main components of the social investigation in China and the present situation, and analyzes the feasibility of college students participating in the social investigation of minors. The third part introduces the exploration of college students' participation in minor social investigation in various regions of our country, and lists the advantages of college students' participation in minor social investigation. The fourth part is according to the domestic and foreign university student to participate in the minor society investigation comparison, summarizes the university student to participate in the minor society investigation process easy to produce four questions. The last part is to put forward four suggestions to solve the above four problems in order to improve the participation of college students in the work of social investigation of minors.
