两岸未成年人观护制度的比较与借鉴

【摘要】：我国大陆地区关于未成年人观护制度未有系统性、实操性的立法,没有设立专门的观护人,观护措施单一且还在试点阶段。台湾地区的未成年人观护制度贯穿于整个未成年人犯罪案件处理的始终,观护人全程参与整个案件的办理。其观护制度的特点在于:一是以国家亲权主义和特别预防思想为理论基础;二是以特别立法、特设机构、特定人员实现了专业化的发展;三是融合调查、评估、保护、矫正、辅导、监督等职能为机制一体化;四是整合社会资源完善社会支持系统。以台湾地区为鉴,大陆地区的未成年人观护制度应做如下改革:对未成年人犯罪的刑事诉讼原则从法定原则向便宜原则转变;犯罪处遇模式从机构处遇向社区处遇更新;建立成年人与未成年人相分离的二元制立法模式;设
[Abstract]:In mainland China, there is no systematic and practical legislation on the system of viewing and nursing of minors, no special nursing observation is established, and the measures of observing nursing are single and still in the pilot stage. The system of viewing and protecting minors in Taiwan runs through the handling of juvenile delinquency cases all the time, and guards participate in the handling of the whole cases all the time. The characteristics of its nursing system are as follows: first, it is based on national paternalism and the idea of special prevention; second, special legislation, special institutions, and special personnel achieve professional development; and third, it integrates investigation, evaluation, protection and correction. Guidance, supervision and other functions for the integration of mechanisms; fourth, the integration of social resources to improve the social support system. Taking Taiwan as an example, the following reforms should be made in the system of viewing and protecting minors in mainland China: the principle of criminal procedure for juvenile delinquency is changed from the principle of legal law to the principle of cheap, the mode of dealing with crime department is renewed from institution to community; To establish a dualistic legislative model for the separation of adults and minors;
