台湾地区公私协力模式下政府责任分析

【摘要】:行政任务的行使,原则上应由政府自行为之,非有法令依据,不应任意交由私部门行使。其用意,不外乎在于避免政府不当转嫁其责任,从而规避公法规范的约束。故台湾地区公私协力的热潮,引起了法学界,尤其是公法学界对政府责任承担的担忧。本文即通过对台湾学术研究成果的系统梳理,分析目前台湾公私协力模式下政府承担责任的范围。在公私协力模式下,很重要的议题是政府责任的分担或共同承担的问题。为分析台湾地区公私协力模式下政府承担的责任范围,本文首先介绍台湾地区公私协力模式的概况,包括起因,法律与政策的发展历程,基本含义以及适用的范围与方式,为后文研究提供基础概念。其次,通过分析不同责任类型,来确定公私协力模式下政府所应承担的责任,即由“给付责任”转向“担保责任”。进而分析政府承担“担保责任”的“宪法”依据及法理支撑。再次,“担保责任”的范围大体上可由法律上的规定和契约中的约定加以限定,通过梳理学术成果及实务中的做法来归纳政府“担保责任”可能的范围。最后,因台湾公私协力模式涉及问题层面广泛,个案差异较大,政府责任承担范围尚无统一的法律法规可以遵循,造成了实务中的困境。故在学术界已有学者开始探讨建立一部统一适用的“担保行政法”,从而规范与界定政府责任的范围。因大陆学术界对台湾此一制度尚未有系统性描述,故本文通过介绍台湾公私协力模式下的政府责任,希望能为大陆学者进行相关研究提供一丝帮助。
[Abstract]:The exercise of administrative tasks should, in principle, be carried out by the government on its own, not on the basis of a decree, but not arbitrarily by the private sector. The intention is to avoid the government passing on its responsibility and avoid the restriction of public law. Therefore, the upsurge of public-private cooperation in Taiwan has aroused the concern of the legal circles, especially the public law circles, about the responsibility of the government. This paper analyzes the scope of the government's responsibility under the public-private cooperation model in Taiwan through the systematic analysis of the academic research achievements in Taiwan. In the model of public-private cooperation, the important issue is the sharing or sharing of government responsibility. In order to analyze the scope of the government's responsibility under the public-private cooperation model in Taiwan, this paper first introduces the general situation of the public-private cooperation model in Taiwan, including the causes, the development course of law and policy, the basic meaning and the scope and method of application. To provide basic concepts for later studies. Secondly, through the analysis of different types of liability, the responsibility of the government should be determined under the model of public-private cooperation, that is, from "pay responsibility" to "guarantee responsibility". Then it analyzes the constitutional basis and legal support for the government to bear the "guarantee responsibility". Thirdly, the scope of "guarantee liability" can be limited by the legal provisions and the agreement in the contract, and the possible scope of the government's "guarantee liability" can be summed up by combing the academic achievements and the practice in practice. Finally, due to the wide range of problems involved in the public-private cooperation model in Taiwan and the large differences in individual cases, there are no uniform laws and regulations to be followed in the scope of government responsibility, resulting in difficulties in practice. Therefore, scholars in academic circles have begun to explore the establishment of a unified application of "guarantee administrative law", so as to regulate and define the scope of government responsibility. Since there is no systematic description of this system in mainland China, this paper, by introducing the responsibility of the government under the model of public-private cooperation in Taiwan, hopes to provide a little help for the relevant research of mainland scholars.
