论平均地权的法理基础

【摘要】："平均地权"思想的提出既有孙中山对现实问题的近思,也有对未来困境的远虑。凭依自然法观点解构封建地主的土地所有权,切中"地权不均"是社会贫富两极分化的症结所在,证成地权是民生权。澄析其从"平均地权"到"耕者有其田"的理论转向,到所有权与使用权分离的制度设置,孙中山试图以社会平等的宏大叙事,扬弃"有田同耕"绝对平均主义,吸纳亨利·乔治"单税论"主张,捍守自然正义一般原则,型构一种更加可行的社会公平与正义样态。本文运用唯物史观分析框架,诠释平均地权这一思想蕴含的"土地正义",回应当下中国工业化、城市化语境中土地法治的新要求,关键在于土地正义的发展与重构。
[Abstract]:The idea of "average land ownership" is not only a reflection of Sun Zhongshan's realistic problems, but also a distant concern for future dilemmas. According to the view of natural law to deconstruct the land ownership of feudal landlords, "uneven land rights" is the crux of polarization between the rich and the poor. From the theory of "average land right" to "the tiller has his field", to the system setting of the separation of ownership and right of use, Sun Zhongshan tries to use the grand narrative of social equality to sublate the absolute egalitarianism of "farming with farmland". To absorb Henry George's theory of single tax, to defend the general principle of natural justice, and to construct a more feasible social equity and justice. This article uses the historical materialism analysis frame to explain the "land justice" contained in the thought of average land right, and to respond to the new request of land rule of law in the context of industrialization and urbanization in China, the key lies in the development and reconstruction of land justice.
