深圳市“三陪女”受不法侵害问题研究

【摘要】：随着改革开放以来我国经济、社会的高速发展,在国内各大城市的各类娱乐场所中大量涌现出“三陪女”。虽然我国社会经济发展取得了显著进步,社会管理的模式也更加民主化、法治化,但仍滞后于经济社会发展需要。政府管理上的忽视,加上整个社会的漠视,使“三陪女”这一群体游离于社会管理的边缘,使之经常受到不法侵害。目前“三陪女”已成为社会边缘和高危人群,也随之引发出一系列社会治安和管理问题。如2011年“河南洛阳囚禁性奴”案轰动全国,不仅引起社会各界对“三陪女”这一群体的广泛关注,更反映了重大的社会治理“黑洞”。虽然“三陪女”经常会被冠以社会价值低、行为败坏等负面影响的头衔,但整个社会应尊重每一个公民的价值,关注每一个群体的存在与发展,这与这个公民的职业、信仰、是否违法犯罪无关,与这个群体所能够创造的社会价值无关。“三陪女”作为社会边缘群体,自身可能会存在一些不完善的因素,她们也许有的人道德败坏,也许有的人甚至违法犯罪,但在经过政府、社会组织等帮助后回归社会仍然具有社会人的价值,我们在社会管理中更不应该忽略这一边缘群体而将其排斥在外。公平、平等是每一位公民乃至“三陪女”应有的权利,让她们完全回归社会,成为社会的一员,又是整个社会的义务和责任。在社会日常管理环节更应关注此类边缘群体的诉求,为她们回归社会、回归家庭创造更加良好的环境。本课题从一起被社会广泛关注的“三陪女”被抢劫杀害案件入手,引发对深圳市“三陪女”受不法侵害社会问题的思考,深入归纳和分析这一社会边缘群体的个体属性和受到不法侵害的深层次原因,认真查找当前“三陪女”边缘群体社会管理方面的薄弱环节。诚然,对于“三陪女”,如果仅采用“严打”的手段是不现实的,不仅不能抑制此类问题,而且可能会促使该问题朝无序方向发展,导致因此引发的治安和刑事违法、社会管理、道德伦理、疾病传播等问题越来越严峻。因此,本课题结合深圳的经验做法,从社会管理角度提出了加强“三陪女”社会边缘群体管理的原则、重点和根本措施,主要目的是既可以使“三陪女”这一边缘群体社会功能得到恢复,充分保障其合法权益,同样可以使当前的社会管理功能得到有效的完善与提高,也将对其他社会边缘群体管理起到良好的借鉴与参考。
[Abstract]:With the rapid development of economy and society since the reform and opening up, a large number of "escort women" have emerged in all kinds of entertainment places in major cities in China. Although China's social and economic development has made remarkable progress, the mode of social management has become more democratic and ruled by law, but it still lags behind the needs of economic and social development. The neglect of government management and the neglect of the whole society make the group of "escort girls" drift away from the edge of social management and make them often be violated illegally. At present, "escort girl" has become the social fringe and high-risk group, which has caused a series of social security and management problems. For example, in 2011, the case of "captive sexual slaves in Luoyang, Henan Province" caused a nationwide stir, which not only caused widespread concern to the group of "escort women", but also reflected the "black hole" of social governance. Although "escort women" are often labeled with negative influences such as low social values and bad behaviour, the whole society should respect the values of every citizen and pay attention to the existence and development of each group, which is related to the profession and belief of this citizen. Whether it is illegal or not is not related to the social value that this group can create. As a marginalized group in society, "escort women" may have some imperfect factors themselves. Some of them may be morally corrupt, some may even commit crimes against the law, but after the government, With the help of social organization and so on, the social return still has the social human value, we should not ignore this marginal group and exclude it in the social management. Fairness and equality are the rights that every citizen and even "escort girl" should have, so that they can return to the society completely, become a member of society, and also be the duty and responsibility of the whole society. In the daily management of society, we should pay more attention to the demands of this kind of marginal groups, and create a better environment for them to return to society and to return to their families. This subject starts with a case of robbery and murder of "escort girl", which has been widely concerned by the society, and leads to the thinking on the social problem of "escort girl" being violated illegally in Shenzhen. This paper sums up and analyzes the individual attributes of this social marginal group and the deep reasons for the illegal infringement, and finds out the weak links in the social management of the current "escort girl" marginal group. It is true that for "escort women", it is unrealistic to use only the means of "severe strike". Not only cannot such problems be suppressed, but it may also lead to a disorderly development of the problem, leading to the resulting law and order and criminal offences. Social management, moral ethics, disease transmission and other issues are becoming more and more serious. Therefore, based on the experience and practice of Shenzhen, this paper puts forward the principles, key points and fundamental measures to strengthen the management of marginalized groups of "escort girls" from the perspective of social management. The main purpose is not only to restore the social function of the "escort women", but also to fully protect their legitimate rights and interests, and also to improve and improve the current social management function effectively. It will also be a good reference for the management of other social marginalized groups.
