当代中国公民协商机制建设研究

【摘要】：协商民主在当代社会已成为人民政治生活中不可缺少的一种民主形式,它能有效地推动民主的进步与发展。基于协商民主理论、唯物史观中国化的运用、马克思主义公平正义观形成的中国公民协商机制是当代中国发展基层协商的重要形式。中国公民协商是一种灵活的协商机制,它的内涵主要体现在中国共产党领导下,中国人民群众内部、人民与政府之间、人民与执政党之间的协商纽带,是有效保障各阶段、各范围、各层次公民的协商民主与治理的新机制,有保障社会稳定、促进民主发展、浸润主流价值观、构筑社会治理现代化的作用。当代中国公民协商机制有平等与自愿相互联系、包容性与公开性相辅相成、理性与商谈互相作用、实质民主与程序民主有机统一、权威性与现实性有效结合的本质特征,居民代表会、民主恳谈会、网络自媒体等是公民协商机制的组织载体。中国公民协商机制已渐呈雏形,社会组织、地方政府都带动了公民协商机制的发展,但鉴于协商主体的意识能力不足以及现实公民协商管理及规则保障机制的不完备性,中国公民协商机制发展的广度、深度和效果并不理想。因此,要结合实际问题对中国公民协商机制建设的路径进行探索,通过对公民协商主体建设、公民协商客体和辅助要素建设、公民协商机制的程序与质量效力建设、社会主义法治层面进一步改善公民协商保障机制等角度解决公民协商机制建设中存在的问题,希冀廓清中国公民协商机制建设的目标、方向和基本路径,促进中国公民协商机制的健康发展和不断完善。
[Abstract]:Deliberative democracy has become an indispensable form of democracy in the political life of the people in contemporary society, and it can effectively promote the progress and development of democracy. Based on the theory of deliberative democracy, the application of historical materialism in China, and the formation of Marxist view of fairness and justice, the mechanism of consultation among Chinese citizens is an important form for the development of grass-roots consultation in contemporary China. The Chinese citizen consultation is a flexible consultation mechanism, and its connotation is mainly embodied in the leadership of the Communist Party of China. The consultation bond between the masses of the Chinese people, between the people and the government, and between the people and the ruling party is an effective guarantee for all stages. The new mechanism of consultation democracy and governance of citizens at all levels has the function of guaranteeing social stability, promoting democratic development, infiltrating mainstream values, and constructing the modernization of social governance. The contemporary Chinese citizen consultation mechanism has the essential characteristics of equality and voluntary interaction, inclusiveness and openness, mutual interaction between rationality and negotiation, organic unity of substantive democracy and procedural democracy, and effective combination of authority and reality. Residents' meeting, democratic conference, network media and so on are the carriers of citizen consultation mechanism. The Chinese citizen consultation mechanism has gradually taken its embryonic form. Social organizations and local governments have all brought about the development of the citizen consultation mechanism. However, in view of the lack of consciousness of the subject of consultation and the imperfections of the management of the real citizen consultation and the guarantee mechanism of the rules and regulations, The breadth, depth and effect of the development of Chinese citizen consultation mechanism are not ideal. Therefore, it is necessary to explore the path to the construction of Chinese citizen consultation mechanism in light of practical problems, through the construction of the main body of citizen consultation, the construction of the object and auxiliary elements of citizen consultation, and the construction of procedure and quality effectiveness of citizen consultation mechanism. In order to solve the problems existing in the construction of citizen consultation mechanism, we hope to clarify the goal, direction and basic path of the construction of Chinese citizen consultation mechanism. To promote the healthy development and continuous improvement of the consultation mechanism for Chinese citizens.
