1927-1937年南京国民政府时期公务员考录任用机制研究

【摘要】:随着南京国民政府的建立和北伐战争的全面胜利,1927-1937年这十年间中国的时局处于一个相对稳定的时期。这一期间南京国民政府在公务员制度现代化进程方面作出了诸多努力。南京国民政府在孙中山“五权宪法”思想的指导下,对于公务员制度中的考录任用机制不断革新以适应世界发展的大潮。该机制不但借鉴了科举机制的优点,而且也学习了西方文官机制的长处。在这一特定时期的运行也对公务员机制的产生及发展产生极其深远的意义,也开启了我国公务员机制的现代化进程。但是由于这一时期的政治、经济、文化等局限性,南京国民政府公务员考录任用机制也存在其本身的缺陷,机制的设计与实际运行的矛盾也同样是阻碍制度科学发展的因素。不可否认的是这一时期的考录任用机制在中国历史上是一次飞跃,也为我国现行的公务员考录任用机制提供一定的借鉴。文章主体分为六个部分:第一部分:导论主要时间本文的相关概念、文章架构及内容、相关研究及研究方法与创新进行阐明。第二部分:主要论述南京国民政府公务员机制形成与发展的背景。第三部分:详细的描述南京国民政府考录任用机制,其考试制度、分发制度、任用机制等,通过对当时的法规法条、官制官规的梳理详细的介绍了这一时期制度本身的内容。第四部分:着重分析了南京国民政府公务员考录任用机制运行的效果及其特征,通过1927年-1937年十年间的制度运行,比较全面的分析出这一时期制度运行的成效及特点。第五部分:评述了南京国民政府公务员考录任用机制的缺陷及其障碍因素,通过分析制度本身设计缺陷、运行中体制性缺陷及制度运行面临的环境缺陷,探究出制度的障碍因素。第六部分:主要研究南京国民政府公务员考录制度对现行公务员制度完善的启示。通过对我国现行公务员考录任用机制的概述及成效、问题等分析。提出我国现行制度应在那些方面参照南京国民政府公务员考录任用机制,对于推进我国公务员制度科学化、法制化有一定积极意义。
[Abstract]:With the establishment of the Nanjing National Government and the overall victory of the Northern Expedition, China's current situation in 1927-1937 was in a relatively stable period. During this period, the Nanjing National Government made a lot of efforts in the process of modernization of the civil service system. Under the guidance of Sun Zhongshan's "five powers Constitution", the Nanjing National Government innovates the examination and appointment mechanism in the civil service system to adapt to the tide of world development. This mechanism not only draws lessons from the advantages of the imperial examination mechanism, but also learns the advantages of the western civil service mechanism. The operation in this particular period also has profound significance to the emergence and development of the civil service mechanism, and also opens the modernization process of the civil service mechanism in our country. However, due to the political, economic and cultural limitations of this period, the civil servant examination and appointment mechanism of Nanjing National Government also has its own defects, and the contradiction between the design of the mechanism and the actual operation is the same factor that hinders the development of institutional science. It is undeniable that this period of examination and appointment mechanism in the history of China is a leap forward, but also for the current civil servant appointment mechanism for reference. The main body of the article is divided into six parts: the first part: the introduction of the main time of the related concepts, article structure and content, related research and research methods and innovation to clarify. The second part: mainly discusses the background of the formation and development of the civil servant system of Nanjing National Government. The third part: detailed description of Nanjing National Government examination appointment mechanism, its examination system, distribution system, appointment mechanism and so on, through the then laws and regulations, official rules of the detailed introduction of this period of the system itself. The fourth part: analyzes the effect and characteristics of the civil servant examination and appointment mechanism of Nanjing National Government emphatically, through the system operation from 1927 to 1937, comparatively comprehensively analyzes the effect and the characteristic of the system operation in this period. The fifth part: comments on the defects and obstacles of the civil servant examination and appointment mechanism of Nanjing National Government, analyzes the defects of the system itself, the system defects in operation and the environmental defects in the operation of the system. Explore the obstacles to the system. The sixth part mainly studies the enlightenment of the civil servant examination system of Nanjing National Government on the perfection of the current civil servant system. This paper analyzes the current mechanism of civil servant examination and appointment in our country. The author points out that the current system of our country should refer to the mechanism of civil servant examination and appointment in Nanjing National Government in those aspects, which is of certain positive significance to promote the scientific and legalized civil service system of our country.
